Gentlemen:
By Proposed Change No. 79-3 dated March 15, 1979, your Company filed Technical Specification changes with the Office of Nuclear Reactor Regulation (ONRR) for review. These changes were stated to be in accordance with the requirements of 10 CFR 50.55.a(g) relating to inservice inspection for PilgrimUnit No.1.
Your Company did not remit a fee as required by 10 CFR 170.22 since this application was required by U.S.N.R.C. regulations. When applications require OURR staff review and action thereon, they are not exempt from the fee requirements of 10 CFR 170.22 although the application may have resulted from a rule change requirement or other U.S.N.R.C. document.
Consequently, your March 15 application is not exempt from fees.
Based on information provided by the ONRR staff as a result of a preliminary fee review of the March 15 application, it has been determined that this application will involve consideration of a single safety issue. Therefore, a Class III fee of $4,000 is required for it and should be remitted to our office.
If the ONRR staff's final review of this application reveals that this fee is not correct, you will be notified and any necessary ad,justment will be made.
