Appendix NOTICE OF VIOLATION Wisconsin Electric Power Company Docket No. 50-266 As a result of the inspection conducted on November 2-30, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:
1.
License Condition 3.H requires, in part, that "The licensee is re-

quired to implement and maintain the administrative controls identi-fied in Section 6 of the NRC's Fire Protection Safety Evaluation Report on the Facility dated August 2, 1979 and supplements thereto."
Paragraph 6.4, " Control of Ignition Sources," of that safety evalua-tion report states, in part, "The Plant Fire Brigade Chief or Assistant Chief's authorization is required for issuance of an " Ignition Source Control Permit" in all areas of the plant except those posted as
" Designated Welding Areas".
This permit requires such items as: the removal of combustible material from the work area; use of trained and equipped fire watches; and a check of the oxyacetylene equipment before it is moved into the work area."
PBNP 3.30 is the plant procedure promulgating the requirements of the safety evaluation report for ignition source control and establishes the requirements for fire watches.
Contrary to the above requirements, on November 6,1981, the in-spector observed welding operations being conducted in the Unit 1 containment without the presence of a fire watch.
This is a Severity Level VI violation (Supplement I).

Appendix Contrary to the above requirements, seven instances were noted between November 6 and November 12, 1981, in which expired ignition control permits were left posted at the job site and not cleared.
This is a Severity Level VI violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompli-ance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be sub-mitted under oath or affirmation. Consideration may be given to extend-ing your response time for good cause shown.
