NRC STAFF SUPPLEMENTAL RESPONSE TO LICENSEE'S_OTIONS OF JANUARY 26, 1981 M

On January 26, 1981, the Licensee in this proceeding (Metropolitan Edison Co., or Met-Ed) submitted two motions to the Commission entitled,

" Licensee's Motion for Amendment of August 9,1979 and March 6,1980 Orders" and " Licensee's Motion to Modify Commission's July 2,1979 Order."

In the referenced motions, the Licensee indicated that it had submitted to the Staff an application for amendment to TMI-1 Operating License No. DPR-50 to permit the transfer of the authority to possess, use and operate the TMI-I facility from the Licensee to GPU Nuclear Corporation (GPUNC).

The Licensee moved the Commission to amend its August 9, 1979 and March 6, 1980 Orders 1/

to authorize the presiding Atomic Safety and Licensing Board to consider the qualifications of GPUNC, rather than Met-Ed, to restart and operate The referenced Commission Orders conferred upon the Board authority 1/

to consider, inter alia., whether Metropolitan Edison's management is sufficiently staffed, has sufficient resources, and is appro-priately organized to operate Unit 1 safety.

restriction on the Licensee that TMI-1 be maintained in a cold shutdown condition.

In its Response to Licensee Motion of January 26, 1981, dated February 17, 1981, the Staff indicated its understanding that the Licensee was not pro-posing that the Commission consider the transfer of responsibilities from l

the Licensee to GPUNC as a part of its consideration of these motions.

Rather, the request was that the Commission simply modify its Orders of July 2 and August 9,1979 and March 6,1980. so that there is rio ambiguity in the authority of t'ne presiding Licensing Board to determine the manage-ment competence of the GPUNC to which the present Licensee, Met-Ed, proposes to transfer the operating authority once GPUNC has received the requisite authority to act as a corporation and operate the facility.

The Staff indicated that it was reviewing the application for amendment of the TMI-1 operating license to substitute GPUNC for Met-Ed as the licensee of the TMI-1 facility, and requested the Commission to defer its rulings on the motions until the Staff had the opportunity to com-On plete its review of the proposed amendment to the TMI-1 license.

March 23, 1981, the,ommission issued an Order in which it deferred ruling on the motions until it had heard further from the Staff. Metropolitan Edison Co. et al. (Three Mile Island Nuclear Station, Unit 1), Order, CLI-81-3, slip op., at 5 (March 23,1981).

The July 2,1979 Order directed the Unit 1 facility to remain shut down until further order of the Commission itself.

. The Staff has completed its review of the license amendment request, and is prepared to issue an appropriate amendment to the TMI-1 Operating License, authorizing GPUNC to replace Met-ed as the operator of the facility.

A copy of the requested amendment and safety evaluation is attached. The safety evaluation supporting the amendment authorization was set forth l

previously in Supple.uent 3 to the Staff's Safety Evaluation for this proceeding (NUREG-0680, Supp. 3; Staff Exhibit 14). The amendment merely recognizes GPUNC as the legal entity which will provide the technical and managerial resources for the operation of TMI-1. GPUNC would consist of the existing functions of GPU Nuclear Group (GPUNG), which is the current operating organizational structure of Met-Ed for TMI-1. GPUNG was formed to combine the technical and managerial resources of Met-Ed, the Jersey Central Power & Light Co., and the GPU Service Corporation into a single organizational entity. Met-Ed was allowed to reorganize its managerent into the GPUNG for TMI-1 as a result of Amendment No. 58 to the Unit 1 operating license, which was issued on September 15,1980.E The GPUNG was to be an interim organization pending the receipt of necessary l

l regulatory approvals to establish the GPUNC.

In supplement 3 to the SER, as well as the attached safety evalua-tion which accompanies the amendment, the Staff indicates that GPUNC has l

The presiding Atomic Safety and Licensing Board has received into evi-dence testimony from parties on the adequacy of the GPUNG and GPUNC organi-zational structures, and therefore already has a record from which to make conclusions regarding the capability of the proposed GPUNC to operate TMI-1.

Further, parties have submitted proposed findings on the licensee's organi-zational structure, includin3 the existing GPUNG and the proposed GPUNC.

Amending the Commission's July 2, 1979, August 9, 1979, and March 6, 1980 Orders would thus not necessitate further hearing sessions to consider the proposed GPUNC as operator of TMI-1.

Pursuant to the Commission's Orders of August 9,1979 and March 6, 4j 1980, the Licensing Board is currently considering the following (1) whether Metropolitan Edison's management competence issues:

management is sufficiently staffed, has sufficient resources and is appropriately organized to operate Unit I safely; (2) whether facts revealed by the accident at Three Mile Island Unit 2 present ques-tions concerning management competence which must be resolved before Metropolitan Edison can be found competent to operate Unit I safely; and (3) whether Metropolitan Edison is capable of operating Unit 1 safely while simultaneously conducting the clean-up operation at Unit 2.

While the proposed amendment does relate in part to these questions, we think it is nonetheless appropriate for the staff to issue the requested amendment upon a favorable determination by the Commission on the licensee's pending motion. The proposed amendment, when read in conjunction with the Comission's July 2,1979 Order, only authorizes the new corporate organization (GPUNC) to conduct those activities now permitted to be performed in the cold shutdown condition. Any authorization to operate the facility beyond this condition is contingent upon the ultimate outcome of the present In its Order of August 9, 1981, the Commission expressly proceeding.

provided that "[w]ithin the limitations of 10 C.F.R. $$50.59 and 2.717(b) of the Commission's regulations, the licensee may commence modifications, such as these recommended above by the Director of Nuclear Reactor Regulation, during the pendency of this proceeding at its own risk." 5-For the reasons set forth above, the Staff supports the licensee's motions to the Commission to amend its Orders for this proceeding dated July 2,1979, August 9,1979, and March 6,1980, clarifying the presiding Board's authority to consider the qualificetions of GPUNC to operate THI-1.

If the Commission approves the requested change the Staff is prepared to subsequently issue the requested license amendment pursuant to the pro-visions of 10 C.F.R. 9 2.717(b).

dated January 26, 1981, complies with the standards and requirements of the Atomic Energy &ct of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.

The facility will operate in confomity with the application, the provisions of the Act, and the rules and regulations of the Comission; C.

There is reasonable assurance (1) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Comission's regulatfor.r; D.

The issuance of this amendment will not be inimical to the comon defense and security or to the health and safety of the public; and E.

The issuance of this amendment is in accordance with 10 CFR Part 51 of the Comission's regulations and all applicable requirements have been satisfied.

requirements of the Atomic Energy Act of 1954, as amended (the Act),

and the Comission's rules and regulations set forth in 10 CFR Chspter 1 and all required notifications to other agencies or bodies iave been duly made; b.

Construction of the Three Mile Island Nuclear Station, Unit 1 (the facility) hcs been subst ntially completed in confonnity with Construction Permit No. CPPR-40, the application, as amended, the provisiens of the Act and the rules and regulations of the Comission; The facility will operate in conformity with the application, as c.

amended, tiie provisions of the Act, and the rules and regulations of the Comission; d.

There is reasonable assurrnce:

(1) that the activities authorized by this operating license can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the rules and regul3tions of the Comission; GPU Nuclear Corporation is technically qualified and the licensees I

After weighing the environmental, economic, technical, and other benefits of the facility against environmental costs and considering available alternatives, the issuance of Facility Operating License No. DPR-50 is in accocdance with 10 CFR Part 50, Appendix 0, of the Commission's regulations and all applicable requirements of said Appendix D have been satisfied; and 1.

The receipt, possession, and use of source, byproduct and special nuclear material as authorized by this license will be in accordance with the Commissien's regulations in 10 CFR Parts 30, 40 and 70, including 10 CFR Section 30.33, 40.32, 70.23 and 70.31, 2.

Facility Operating License No. DPR-50 is hereby issued to the Mef.ropolitan Edison Company, Jersey Central Power and Light Company, Pennsylvania Electric Company and GPU Nuclear Corporation to read as follows: l This license applies to the Three Mile Island Nuclear Station, Unit 1, a.

Light Company, Pennsylvania Electric Company and operated by GPU Nuclear Corporation. The facility is located in Dauphin County, Pennsylvania and is described in the " Final Safety Analysis Report" as supplemented and amended (Amendments 1 through 47) and the Environmental Report as supplemented and amended (Amendnents 1 and 2).

Subject to the conditions and requirements incorporated herein, the Commission hereby licenses:

(1) GPU Nuclear Corporation, pursuant to Section 104b of the Act l

and 10 CFR Part 50, " Licensing of Production and Utilization Facilities,' to possess, use, and operate the facility; and Metropolitan Edison Company, Jersey Central Power and Light l

Company and Pennsylvania Electric Company to possess the facility in accordance with the procedures and limitations set forth in this licens2; (2) GPU Nuclear Corporation, pursuant to the Act and 10 CFR l

Parts 30, 40 and 70 to receive, possess and uce at any time any byproduct, source and special nuclear material as reactor fuel, sealed neutron sources for reactor startup, sealed sources for reactor instrementaticn and radiation monitoring equipment calibration, and as fission detectors in amounts as required for reactor operation;

_, (3) GPU Nuclear Corporation, pursuant to the Act and 10 CFR l

Part 30 to receive, possess and use any tin.e 100 millicuries each of any byproduct material without restriction to chemical or physical form, for sample analysis or instrument calibration; (4) GPU Nuclear Corporation, pursuant to the Act.and 10 CFR l

Parts 40 and 70 to receive, possess and use any time 100 milligrams each of any source or special nuclear material without restriction to chemical or physical form, for sample analysis or instrument calibration; (5) GPU Nuclear Corporation, pursuant to the Act and 10 CFR l

Parts 30 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility.

This license shall be deemed to contain and is subject to the con-c.

ditions specified in the following Commission regulations 10 CFR Chapter I: Part 20. Section 30.34 of Part 30. Section 40.41 of Part 40, Section 50.54 and 50.59 of Part 50, and Section 70.32 of Part 70; is subject to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

(1) Maximum Power Level I

GPU Nuclear Corporation is authorized to operate the facility at steady state reactor core power levels not in excess of 2535 megawatts thermal.

JERSEY CENTRAL POWER AND LIGHT COMPANY PENNSYLVANIA ELECTRIC COMPANY GENERAL PUBLIC UTILITIES NUCLEAR CORPORATION THREE MILE ISLAND NUCLEAR STATION, UNIT NO. 1 DOCKET NO. 50-289 Introduction By letter dated January 26,1981 (TLL 668) the licensee requested the license te amended to reflect that General Public Utilities Nuclear Corporation (GPUNC) is to replace Metropolitan Edison Company (Met-Ed) as the licensee authorized to operate the Three Mile Island Nuclear Station, Unit No.1 (TMI-1). This amendment changes the operating license No. DPR-50, Appendix A Section 6 and Appendix B Section 5 to reflect this change in authority.

Discussion and Evaluation By letter dated January 26,1981 (TLL 668) the licensee proposes to amend Operating License No. DPR-50 to permit the GPU Nuclear Corporation (GPUNC) to replace Metropolitan Edison Company (Met-Ed) as the sole entity authorized to operate the TMI-1 Nuclear Power Plant. Changing the name in the ifcense which identifies the authorized operator of TMI-1 has no adverse impact on safety issues related to plant operation so long as the authorized operator is qualifled from a managaria' standpoint to adequately operate TMI-1. The staff has reviewed management qualifications of GPUNC and finds their management adequately qualifies to operate TMI-l under license DPR-50.

In addition, Amendment No. 58 to the Operating Licensa for Three Mile Island Nuclear Station, Unit 1 (DPR-50), issued on September 15, 1980, approved changes requested by the licensee permitting the establishment of the GPU Nuclear Group (G?UNG). This group combined the technical and managerial resources of Jersey Central Power & Light Company (JCP&L),

Metropolitan Edison Company (Met-Ed), and the General Public Utilities (GPU) Service Corporation generation divisions into a single organizational entity. GPUNG was formed for the express purpose of managing nuclear affairs for GPU. Specifically, Amendment No. 58 authorizes the GPUNG to operate and manage TMI-1.

In its application for approval of the GPUNG, the licensee stated that the ultimate goal was to form a GPU Nuclear Corporation (GPUNC) which Staff evaluation of the requested change to would replace the GPUNG.

GPUNG, approved by Amendment No. 58, was performed with the knowledge that a further request would be forthcoming to change from the GPU Nuclear Group to the GPU Nuclear Corporation. The licensee now requests this change from GPUNG to GPUNC.

Under the terms of the requested change, the operating license would recognize GPUNC as the legal entity which will provide the technical and managerial resources for the continued safe operation of TMI-1.

The requested change involves no change in the ownership of TMI-l and no changes to the faci 1Py. However, operational control of TMI-l would shif t from GPUNG to TPUNC.

GPUNC would not own or finance nuclear or other utility assets. Under the proposed arrangemcit, which would be firmed up contractually should GPUNC assume operational accountability for TMI-1, financial responsi-bility for TMI-l operation would remain with GPU's three operating sub-sidiaries in their current levels: Met-Ed 50%, JCP&L 25%, and PENELEC 25%.

Under this proposed agreement, these companies would provide GPUNC with the necessary financing to cover the costs of operating Tfil-1.

All of the existing functions of GPUNG, as approved by Amendment No. 58 to the operating license, are included in the new organization. The onsite groups will continue to receive backup support from GPUNC. So far as operation of TMI-1 is concerned, the only changes are in position titl es. Personnel remain the same. The requested changes to Appendices A and B of the Technical Specifications reflect these changes to the position titles. No changes to the qualifications of any positions delineated in Appendices A and B are involved.

Our evaluation of the organization and management of TMI-l for the restart was based on the GPUNG as the plant operator.

In addition we concluded in NUREG-0680 supplement No.1 (P. 23) that the licensee's existing coninand and administrative structure at both the plant and corpnrate levels is appropriately organized to assure safe operation of TMI-1. The GPUNG was the plant operator at the time when the review was made part of the Commisson's order and reported in NUREG-0680, Supp. 1.

This requested change involves only a change of titles.

Personnel, organization and functions remain the same as for the previously approved GPUNG. Thus, we conclude that this requested change would have no adverse impact on the safety of plant operation.

To accomplish this change, the Figures 6-1, " Organization Chart for GPU Nuclear Corporation" and 6-1 A, "Onsite Organization," would be inserted in the Technical Specifications, replacing the existing Figures 6-1, "Onsite Organization," and 6-1, " Organization Chart GPU Nuclear Group." Also, the table following the figures in the existing Technical Specifications, which compares the organization chart titles for the GPUNG to the titles used throughout Section 6 of the Technical Specifications, should be replaced with a

table which compares the organizational chart titles for the GPUNC l

to the Section 6 titles.

Finally, a replacement page 59A, which compares position titles of the GPUNC with titles used in Sect'on 5 of Appendix B to the Technical Specifications should be inserted in Appendix B

o 3-and the license DPR-50 should be changed to show that GPUNC is the licensee authorized 'to 6perate TMI-1 and not Met-Ed. -

Based on the above evaluation and our review of the licensee's submittal, we find the request to replace Met Ed with GPUNC as the licensee to operate.

TMI-1 is acceptable.

Environmental Consideration We have determined that the amendment does not authorize a change in effluent types or total amounts nor an increase in power. level and will not result in any significant environmental impact. Having made this determination, we have further concluded that the amendment involves an action which is insignificant from the standpoint of environmental impact and, pursuant to 10 CFR 551.5(d)(4), that an environmental impact statement, or negative declaration and environ-mental impact appraisal need not be prepared in connection with the issuance of this amendment.

Conclusion We have concluded, based on the considerations discussed above, that:

(1) because the amendment does not involve a significant increase in the probability or,onsequences of accidents previously considered and does not involve a significant decrease in a safety margin, the amendment does not involve a significant hazards consideration, (2) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (3) such activities will be conducted in compliance with the Commission's regulations and the issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.
