SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT 50-528/93-05, 50-529/

93-05, AND 50-530/93-05)

This refers to the inspection conducted by Messrs. D. Schaefer and M. Schuster

of this office on January 25-29, and February 11-12, 1993. The inspection

included a review of activities authorized for your Palo Verde facility.

On

January 29, 1993, at the conclusion of the initial site visit, the preliminary

findings were discussed with Mr. Paul Caudill and members of your staff

identified in the enclosed inspection report. On February 12, 1993, the

preliminary findings were discussed with Messrs. Tom Bradish and Frank Kroll

of your staff.

Areas examined during this inspection included activities related to physical

security as described in the enclosed inspection report. Within these areas,

the inspection consisted of selective examination of procedures and

representative records, interviews with personnel, and observations of

activities in progress. The inspection findings are documented in the

enclosed inspection report.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). The violation pertained to your failure to properly

,

maintain your protected area perimeter fence.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this

Notice, iricluding your proposed corrective actions and the results of future

inspection, the NRC will determine whether further NRC enforcement actions is

necessary to ensure compliance with NRC regulatory requirements.

The response directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.

The material enclosed herewith contains Safeguards Information as defined by
