PROPOSED RULEMAKING CONCERNING THE ACCESSIBLE AIR-GAP FOR GENERALLY-LICENSED DEVICES In response to the memorandum requesting review of the above proposed rulemaking package, I have reviewed the Commission paper and draft Federal Register notice. I am still in the process of completing my review of these documents and the draft Regulatory Analysis. I am providing the attached mark-up so that you will have my comments to-date at the earliest opportunity. My main comment is that this rulemaking is substantive and does not appear to be within the scope of any of the categorical exclusions in S 51.22(c). Therefore, an environmental assessment is necessary.
