Nuclear Materials Safety Branch Insoection Summary Inspection on February 19. 1993 (Recort No. 999-90003/93004(DRSS))
i Areas Inspected: This special, announced inspection was conducted to evaluate compliance with Commission rules and regulations, limited to reciprocity for an Agreement State licensee to conduct licensed activities in non-Agreement, or NRC states. The inspection included a review of the scope of the licensee's program, extent of licensed activity in non-Agreement States, and authorization granted in their State of Illinois license.
Results: The inspection resulted in the identification of one apparent violation of NRC regulatory requirements, as follows:

license with the Director of the appropriate NRC office at least three days prior to engaging in licensed activities on 94 occasions betweer.

Licensed Procram Standard Nuclear Consultants, Ltd. (SNC) is licensed by-the State of Illinois to provide a variety of services to clients.
Examples of types of services authorized on their license are survey meter calibration, leak testing, decontamination, source exchange, and removal, installation and relocation of industrial gauges. The licensee is authorized to use material at temporary job sites in the State of 1111nois. Their primary licensed activities are calibration of survey meters and collection of leak test samples.
The majority of SNC's work is conducted in Indiana, Illinois, and Wisconsin. Their client base is primarily medical in nature.
The licensee informed the inspectors that they have not provided industrial gauge service involving installation, removal, or relocation of gauging devices in years.
10 CFR 150.20, in part, provides thht persons who hold a specific license from an Agreement State are granted an NRC general license to conduct the same activity in a non-Agreement State, provided the general licensee complies with 10 CFR 150.20(b).

Enforcement History The licensee terminated their NRC license in October of 1990. A review of the terminated file revealed that SNC was first issued an NRC license on August 4, 1983.
There is no documentation in the file to indicate the licensee was ever inspected by the NRC.

Oraanization Standard Nuclear Consultants, Ltd. (SNC) is owned and operated by Jim Mikowski and Stan Buhr.
In addition to specifying Mr. Mikowski and Mr. Buhr as authorized users, their State of Illinois license also identifies Mr. P. Wennert and Ms. R. Bauer as authorized users.
However, Mr. Mikowski informed the inspectors that Mr. Wennert and Ms. Bauer no longer work for SNC. Mr. Mikowski is also named as the i
company's ' Radiation Safety Officer.

Inseection Summary 10 CFR 150.20(b)(1) requires that, when engaging in activities in non-Agreement States under the general license granted by 10 CFR 2
150.20(a), four copies of Form NRC-241 (revised) and four copies of the Agreement State specific license be filed with the Director of the appropriate NRC office at least three days prior to engaging in such activity.
This inspection, conducted on February 19, 1993, was performed as a result of a previous inspection of Worthington Regional Hospital, License No. 22-15169-01, an NRC licensee in the State of Minnesota.
During the inspection of Worthington Regional Hospital, the inspector discovered that Standard Nuclear Consultants, Ltd. (SNC) performed a survey meter calibration on-site using SNC's cesium-137 source (approximately 83 millicuries). Upon return to the Region III office, a review of reciprocity records maintained by Region III revealed that there were no records of SNC filing reciprocity for the work performed in Minnesota. Region III then contacted a representative of SNC and questioned if they had filed Form NRC-241 for the work conducted in Minnesota. The representative indicated that they had not and that they had never filed for reciprocity with the NRC. The SNC representative was then informed of the requirements of 10 CFR Part 150.20.
On 1
January 25, 1993, SNC filed Form NRC-241 and a copy of their Agreement State license for work planned in 1993. Also included was a summary of work conducted in NRC states during calendar year 1992, along with a check in the amount of 640 dollars to cover the 1993 reciprocity fee.
The inspection conducted on February 19 was an announced inspection at the licensee's facility located in Elburn, Illinois.
The inspectors reviewed 10 CFR 150.20 with the licensee and emphasized the importance of filing Form NRC-241. The inspectors also informed the licensee that in February of 1992, 10 CFR Part 2, Appendix C, Supplement VI, was revised regarding failure to file Form NRC-241 in accordance with 150.20.
The inspectors inquired as to when SNC first became aware of the requirements of 10 CFR Part 150.20. According to the licensee, they received a copy of a news release sometime in late 1992 which announced a proposed fine against an Agreement State licensee for failing_to inform the NRC that it was performing work in NRC states. During the interview, it was determined that the name of the company was American Testing and Inspection, Inc.
Further research revealed that News Announcement Rill-92-46 was issued on October 26, 1992 for American Testing and Inspe-tion, Inc. The inspectors inquired as to why the licensee did not file Form NRC-241 after reading the news announcement.
The licensee stated they felt that because their_ Illinois license authorizes temporary job sites, they could use material in NRC states.
The inspectors pointed out to the licensee that their Illinois license authorizes temporary job sites only in the State of Illinois. The licensee's failure to file copies of Forms NRC-241 and the Aareement State specific license as reouired constitutes an apparent violation of 10 CFR 150.20(b)(1).
In addition to performing licensed activities in NRC states during i
calendar year 1992, SNC did licensed work in late 1990 and calendar year 3

1 1991 as well. As previously stated, the licensee failed to file Form NRC-241 and copies of their Agreement State specific license.
Attachment' 2 to this report is a summary of licensed work Standard Nuclear Consultants, Ltd. performed in NRC states for calendar years 1990, 1991, and 1992.
The safety significance of the violation is minor because the service the licensee provides does not normally create dangerous situations when under adequate control. Also, the licensee is well _ qualified to provide the services rendered.
One apparent violation was identified.

Exit Meetina On February 19, 1993, the inspectors conducted an exit interview with J
Mr. Mikowski and summarized the apparent violation, and the NRC's j
enforcement options and policy. No proprietary information was identified to the inspectors.
