NRC INSPECTION REPORT NO. 999-90003/93004(DRSS)

This refers to the inspection conducted by G. L. Shear and K. G. Null of this office on February 19, 1993. The inspection included a review of activities conducted in NRC, non-Agreement States, limited to an evaluation of compliance with the NRC regulations pertaining to reciprocity for Agreement State licensees in 10 CFR 150.20. The findings were discussed with you at the conclusion of the inspection.

Areas examined during the inspection are identified in the report. Within these areas, the inspection consisted of selective examinations of representative records and interviews with personnel.

Based on the results of this inspection, one apparent violation was identified and is being considered for escalated enforcement action in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy),10 CFR Part 2, Appendix C (1992).

Failure.to file Form i

NRC-241 for licensed activities performed in non-Agreement States is an apparent violation of 10 CFR 150.20(b)(1). Accordingly, no Notice of Viciation is presently being issued for these inspection findings.

In addition, please be advised that the number and characterization of apparent violations described in the enclosed inspection report may change as a result of further NRC review.

An enforcement conference to discuss this apparent violation has been scheduled for 1:00 p.m. on March 18, 1993, at the Region III office, i

799 Roosevelt Road, Glen Ellyn, Illinois. This enforcement conference will be open to public observation in accordance with the Commission's trial program as discussed in the enclosed Federal Register notice. The purposes of this conference are to discuss the apparent violation, its cause and safety i

significance; to provide you the opportunity to point out any errors in our t

inspection report; and to provide an opportunity for you to present your proposed corrective action (s).

In addition, this is an opportunity for you to l

provide any information concerning your perspective on (1) the severity of the issue, (2) the factors that the NRC considers when it determines the amount of l

a civil penalty that may be assessed in accordance with Section VI.B.2 of the Enforcement Policy, and (3) the possible basis for exercising discretion in accordance with Section VII of the Enforcement Policy.

You will be advised by separate correspondence of the results of our deliberations on this matter.

No response regarding the apparent violation is required at this time.
