APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-245 License No. DPR-21 Millstone Unit 1 During an NRC inspection conducted from February 1 - 4, 1993, a violation of NRC

.muirements was identified. In accordance with the ' General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1993), the violation is listed below:

Technical SpeciGcation 6.5.3.7.b. requires that the Nuclear Review Board perform audits that encompass: The performance, training, and qualifications of the unit staff at least once per 12 months.

The Nodheast Utility Quality Assurance Program endorses ANSI N18.7/ANS-3.2-1976, which defines criteria for audits of the onsite operating staff [ unit staff for Millstone 1). ANSI N183, Section 4.5, " Audit Program," states, in part, that audits I

shall include programs for training, retraining, qualification and performance of the operating staff. Section 2.0, " Definitions," defines the onsite operating staff as, "Onsite personnel concerned with operations...."

9 Contrary to the above, during the period from January 1,1987, to January 1,1993, r

the licensee did not perform an audit of the programs for training, retraining, qualification and performance of the operation staff (which includes licensed operators).

This is a Severity Irrel IV violation (Supplement I).

I Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATFN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation; or, if contested, the basis for disputing the violation; (2) the corrective steps that have been taken

and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the respon;e time.
