i APPENDIX A NOTICE OF VIOLATION Gulf States Utilities Docket:

50-458 River Bend Station License: NPF-47 During an NRC inspection conducted on January 19-22, 1993, two violations of NRC requirements were identified. The violations involved a failure to' follow the requirements of a drill. procedure and inadequate protection of safeguards-information.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violations are listed below:

A.

Failure to Follow Orill Procedure Condition 2.D of the River Bend Station Operating License NPF-47, requires the licensee maintain in effect and fully implement all provisions of the Commission approved Physical Security-Plan _ This includes' amendments and changes made pursuant to the authority of-10 CFR 50.54(p).

The Introduction Section of the Physical Security Plan states that security procedures provide the detailed instructions necessary to -

implement the plan.

Paragraph 6.2 of Security. Procedure PSP-4-501 requires notification of z the control room, local law enforcement agencies. and members of the' security shift that a drill will be conducted. Paragraph 6.3.2 of Security Procedure PSP-4-501 also requires that actual penetration of the protected or vital areas not occur during drills.

Contrary to the above, on July 27, 1992, licensee personnel failed to notify-the appropriate personnel that a drill-was being conducted.

Further, during test drills, licensee personnel failed to adequately.

search a package that penetrated the protected area.,

This is a Severity Level IV violation (Supplement III) (458/9302-02).

B.

Inadeouate Protection Of Safeouards Information 10 CFR 73.21 requires that all safeguards information be marked in;a:

either be in the possession of someone authorized access-to the-

't information or that it be' stored in an approved container.

-l Contrary to the above, on January 2,1992, the licensee introduced a i

safeguards information document into the work' request-system without' marking or protecting it as safeguards.information. Further, on-April 'I6,1992, a copy of the Physical Security Plan was -left unattended

on a desk outside the protected area for about 5 minutes.

This'is a Severity Level'IV violation (Supplement III)_ (458/9302-03).

Pursuant to the provisions of 10 CFR 2.201, Gulf' States Utilities is hereby required to submit a written statement or explanation to the Regional-

Document Control Desk, Washington, D.C. 20555, within t

30 days of the-date of the letter transmitting this Notice of _ Violation -

-(Notice). This reply should be clearly marked as.a " Reply to a Notice of Violation" and should include for each violation: '(1) the reason for' the violation, or, if contested, the basis for disputing the ' violation, (2) the corrective steps that have been taken and the results achieved, (3)-the corrective steps that will be taken to avoid further violations, and:(4) the j

date.when full compliance will be achieved.

If_an adequate' reply is not received within. the _ time. specified in this Notice, the Commission may issue an-Order or Demand for Information as to why such other action as may be proper y

Where good cause is shown, considerationL will be-given to extending the response time.
