Gentlemen:
SUBJECT: NOTICE OF VICLATION (NRC INSPECTION T.! PORT N05. 50-275/90-02 AND
50-323/90-02)
This refers to the inspection conducted on February 5-14 1990, at your Diablo
Canyon Power Plant. Theinspectionincludedane<aminatlonofthecircumstances
associated with three security violations that you ider+1fied in your logs.
The
report of this inspection was sent to you on March 3, 1990.
Subsequently, an
Enforcement Conference was held with you and members of your staff on March 16,
1990. At that time we discussed with you the violations along with other
apparent violations identified in the report, their causes, your cortar.tive
actions, and our concerns. A summary report of the conference was sent to you
on March 27, 1990.
The violations described in the enclosed Notice of Violation (Notice) which were
identified as a result of reviewing your logs include:
(1) unauthorized
individuals gaining access to vital areas; (2} authorized individuals not being
logged into vital areas and (3) failure to appropriately protect safeguards

breakdown in your management and control system to preclude repeat violations
of NRC requirements.

The other violations identified

in the enclosed Notice since the criteria set forth in 10 CFR Part 2, Appendix
C,Section V.G.1 were found to have been satisfied.
In accordance with the " General Statement of Policy and Procedure for NRC
Enforcement Actions," 10 CFR Part 2 Apaendix C (1989), a civil penalty is
considered for a Severity Level III, pro)1em.
However, after consultation with

the Director, Office of Enforcement, and the Deputy Executive Director for
!
Nuclear Materials Safety, Safeguards, and Operations Support, I have decided
that a civil penalty will not be proposed in this case because you identified
j
the violations, have initiated a comprehensive program to preclude recurrence
of the violetions, and because your past performance in the safeguards area has
been good.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In view of the
j
number of self-identified violations, please provide in your response an
assessment of your program to assure timely corrective actions to preclude
recurrence of the violations.
After reviewing your response to this Notice,
including your proposed corrective actions and the results of future inspections,
i
the NRC will determine whether further NRC enforcement action is necessary to
ensure compliance with NRC regulatory require m ts.

The material enclosed herewith contains Safeguards Information as defined by
10 CFR Part 73.21, and its disclosure to unauthorized individuals is prohibited
by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the
material will not be placed in the Public Document Room.
The responses directed by this letter and the enclosed Notice are not subject
to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Public Law No.96-511.
