APPENDIX A NOTICE OF VIOLATION New York Power Authority.

Docket No. 50-333 James-A. FitzPatrick Nucle,r Power Plant License No. DPR-59.

As a result of the inspection conducted on February 20 through March 2,1990, and in accordance with the " General Statement of Policy and Procedure for NRC.

Enforcement Actions,"'10 CFR Part 2, Appendix C (Enforcement Policy), the following violation was identified:

Section 50.9 of 10CFR 50 states, in part, that information provided to the Commission by a licensee shall be complete and accurate in all material aspects.

The New York Power Authority's December 15, 1989-application.for an amendment-to-the'FitzPatrick Technical Specification states the following:

" Plant procedures have been revised to. reflect the.new limits for water and sediment and ash."

" Plant procedures have been revised as appropriate.to reflect the new limits for diesel fuel quality,"

Contrary to the above, as of February 22, 1990 procedure PSP-7, " Diesel Fuel Oil Sampling and Analysis," which lists the oil quality limits as required:by the technical specifications, had not been revised as stated.

This is a Severity Level IV Violation (Supplement I).

Pursuant to the provisions of-10 CFR 2.201, the New York Power Authority is hereby required to submit to this office within thirty days of the date of the letter whicn transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken.to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
