Region I Inspection Report No. 50-333/90-13

This letter refers to the routine safety inspection by Messrs. T. Koshy and

J. Lara at the James A. FitzPatrick Nuclear Power Plant in Scriba, New York.

The reporting period ~ covers the time from February 20 through March 2,'1990.

The inspection consisted of document reviews, interviews and observation of

activities as described in the NRC Region I Inspection Report' which is enclosed

with this letter. The findings were summarized and discussed with you and

members of your staff at the conclusion of the inspection.

This inspection covered two areas:

(1) the fire protection program and related

activities and (2) your actions taken in response to our letter, dated

August 22, 1989, which transmitted the results of the Safety System Functional

Inspection (SSFI) conducted by the NRC in May 1989. Our evaluation of these

actions is presented in the enclosed report. We acknolwledge receipt of your

letter, dated September 21, 1983, regarding the findings of theJSSFI, and have-

noted your disagreement with several of the violations - We will respond to

l

your comments in a separate letter.

Based on the results of this inspection, it appears that one of your

'

activities was not conducted in full compliance with NRC requirements, as set

forth in the Notice of Violation, enclosed herewith as Appendix:A. .The

violation in the Notice involves one example of NYPA having provided NRC

inaccurate information in a Technical Specifications change submittal. This

violation has been categorized by severity-level- in accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"-

10 CFR- Part 2, Appendix C (Enforcement Policy).

You are required to respond

to this letter and in preparing your response, you should follow the

instructions in Appendix A.
