On January 22, 1979, and February 8,1980, the Office of Nuclear Reactor Regulation (ONRR) approved your application dated June 27,1978, with the issuance of Amendments 43 and 47 to Facility Operating License No.
DPR-36. This application related to the deletion of certain Environmental Tecnnical Specifications for the Maine Yankee Atomic Power Station. With this application and by letter dated October 2,1978, you remitted a total of $4,000 (Class III fee) pursuant to 10 CFR 170.22.
It has been determined that fees should not be charged for the deletion of non-radiological aquatic LCO's and other non-radiological monitoring require-ments in cases where licensees have an effective NPDES permit. On this basis, we nave concluded that an exemption, pursuant to 10 CFR 170.11(b), from the fee requirement is authorized by law and such exemption is otherwise in the public interest and is hereby granted for your June 27, 1978 application.
Therefore, we have concurrently authorized the Office of the Controller to refund you the $4,000 paid with your application. Refunds are generally processed by the Office of the Controller witF.in a two-week period.
