Gentlemen:

This refers to an inspection conducted by Mr. D. Skov of the NRC Region V

office on August 24, 1981, of a shipment of radioactive waste from the

,

Zion Nuclear Power Plant on its arrival at the Richland waste burial site.

The enclosed copy of our inspection report identifies areas examined during

the inspection. The inspection consisted of a review of shipping papers,

placarding and marking requirements, and selective contamination surveys

and radiation measurements.

Based on the results of this inspection, it appears that certain of your

activities were not conducted in compliance with NRC requirements as set

^

forth in the Notice of Violation, enclosed as Appendix A.

Supplement V of the NRC's Proposed General Statement of Policy published

in the Federal Register (45 FR 66754) October 7,1980, sets forth the

s_everity levels for violations of transportation regulations. The viola-

l

tion has been categorized at the severity level dercribed in Appendix A.

You are required to respond to this letter, and in preparing your response

j

should follow the instructions in Appendix A.

The violation for which you have been cited has alreacy been the subje('

of enforcement action by the State of Washington. The state suspended

your burial permit from August 26 to September 14, 1981.

In view of the

circumstances surrounding this matter, we have exercised our discretion

under the Interim Enforcement Policy (45 FR 66754) October 7, 1980, and

have chosen to issue at this time the enclosed Notice of Violation.

After reviewing your response to this Notice of Violation and your

proposed corrective actions, the NRC will determine whether further NRC

enforcement action is necessary in order to ensure compliance with NRC

regulatory requirements.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy

of this letter, the enclosures, and your response to this letter will be

placed in the NRC's Public Document Room.

If the enclosures contain any

information that you or your contractors believe to be exempt from dis-

closure under 10 CFR 9.5(a)(4), it is necessary that you (a) notify this

office by telephone within seven (7) days from the date of this letter of

your intention to file a request for withholding; and (b) submit within

twenty-five (25) days from the date of this letter a written epplication

to this office to withhold such information.

Section 2.790(b)(1) requires

that any such application must be accompanied by an affidavit executed by

the owner of the information which identifies the document or part sought

to be withheld, and which contains a full statement'of the reasons which

are the bases for the claim that the information should be withheld from

l

public disclosure. This section further requires the statement to address

!

with specificity the considerations listed in 10 CFR 2.790(b)(4). The

i

information sought to be withheld shall be incorporated as far as possible

into a separate part of the affidavit.

If we do not hear from you in this

regard within the specified periods noted above, a copy of this letter,

,

the enclosures, and your response to this letter will be placed in the

Public Document Room.

We will gladly discuss any questions you have concerning this inspection.
