Appendix A NOTICE OF VIOLATION Commonwealth Edison Company Docket No. 50-295 Docket No. 50-304 As a result of an inspection conducted on August 24, 1981, at the U.S.
Ecology waste disposal site, Richland, Washington, and in accordance with the Interim Enforcement Policy, as published in the Federal Register (45 FR 66754) October 7, 1980, the following violation was identified.
10 CFR 71.5 prohibits transport of any licensed material outside the confines of the plant or other place of use or delivery of licensed materials to a carrier for transport unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.
49 CFR 173.392(c)(1) requires that materials be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transport.
Contrary to the above, metal bin number 213 in a shipment of LSA waste from the Zion Nuclear Power Station leaked radioactive materia).
This is a Severity Level III violation (Supplement V.C.I.).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:
(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or a ffi rma tion.
Consideration may be given to extending your response time for good cause shown.
