4 Appendix A NOTICE OF VIOLATION 1.
Consumers Power Company Docket No. 50-155 As a result of an inspection conducted on October 1, 1981, and in accordance with the Interim Enforcement Policy, (45 FR 66754) October 7,.1980, the J
following violation was identified:
10 CFR 71.5 prohibits delivery of licensed material to a carrier for transport unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.
49 CFR 173.292(j)(2) limits the radiation level at any point on the external surface of an exclusive use, closed transport vehicle to 200 mR/hr.
Contrary to the above, on October 1, 1981, a radiation level of up to 300 mR/hr was measured on the undersurface of the transport vehicle containing low-level radioactive waste from the Big Rock Point Nuclear Plant.
This is a Severity Level V violation (Supplement V).
Pursuant to the provisions of 10 CFR 2.201, Consumers Power Company is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including for each violations: -(1) admission or denial of the alleged violation; (2) the reasons for the violation if admitted;'(3) the corrective steps I
which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further noncompliance; and (5) the date when full compliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
Consideration may be given to extending your response time for good cause shown.
