This refers to an inspection conducted on October 1, 1981, by a repre-sentative of the Department of Social and Health Services, State of Washington, of a waste shipment from the Big Rock Point Nuclear Plant upon arrival of the shipment at the Richland, Washington low-level waste burial site and to our discussion of tLe inspection findings with' Mr. B. Schrader on October 29,~1981.
During the inspection, a radiation level that exceeded the limit permitted by regulations of'the Nuclear i
Regulatory Commission was measured on the external surface of the trans-port vehicle. The results of the State's inspection were conveyed to your company by letter dated October 1, 1981, from the State of Washington.
Supplement V of the NRC's Proposed General Statement of Policy published i
in the Federal Register (45 FR 66754) October 7, 1980, sets forth the severity levels for violations of transportation regulations. The violation has been categorized at the severity level described in Appendix A.
You are required to respond to this letter, and in preparing your response you should follow the instructions in Appendix A.
The violation fcr which you have been cited has already been the subjcet of enforcement action by the State of Washington. On October 1, 1981, the State of Washington suspended your burial permit.
In view of the circumstance surrounding this matter, we have exercised our discretion under the Interim Enforcement Policy (45 FR 66754) October 7, 1980, and have chcsen to issue at this time the enclosed Notice of Violation.
Af ter reviewing your response to this Notice of Violation and your pro-posed corrective actions, the NRC will determine whether further NRC enforcement action is necessary in order to ensure compliance with NRC regulatory requirements.

Consumers Power Company NOV 5 1981 In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter, the enclosures, and your response to this letter will be placed in the NRC's Public Document Room.
If the enclosures contain any information that you or your contractors believe to be exempt from dis-closure under 10 CFR 9.5(a)(4), it is necessary that you (a) notify this office by telephone within seven (7) days from the date of this letter of your intention to file a request for withholding; and (b) submit within twenty-five (25) days from the date of this letter a written application to this office to withhold such information. Section 2.790(b)(1) requires that any such application must be accompanied by an affidavit executed by the owner of the information which identifies the document or part sought to be withheld, and which contains a full statement of the reasons which are the bases for the claim that the information should be withheld from public disclosure. This section'further requires the statement to address with specificity the considerations listed in 10 CFR 2.790(b)(4). The information sought to be withheld shall be incorporated as far as possible into a separate part of the affidavit.
If we do not hear from you in this regard within the specified periods noted above, a copy of this letter, the enclosures, and your response to this letter.will be placed in the Public Document Room.
