Dear Chairman Selin:

The Pennsylvania Institute for Clean Air recently-filed a petition, pursuant to the provisions 10 CFR 2.206, which requested that the NRC expand the ten mile evacuation zone around Three. Mile Island in Pennsylvania to a broader area of at least 20 miles.

An NRC Director's Decision has been rendered in this matter, which served to deny the request. This correspondence, therefore, is to respectfully petition and request that this matter be taken up by the Commissioners as a Commission-Level consideration.

There are compelling reasons for doing so:

1.

A small portion of the City of Harrisburg is already within the ten mile radius area of TMI. We well know from our experience during the accident of 1979, even in the absence of an ordered evacuation, that tens of thousands of persons did and would again leave the geographic area not only within the ten mile zone but outside of the ten mile zone.

Radiation emissions, a matter which the public does not fully understand, causes immediate concern and alarm, particularly since it cannot be seen, heard or initially felt.

2.

We have not the slightest doubt that if a major incident again occurred at TMI, particularly one that would necessitate an evacuation order within the ten mile zone, that there would be a mass exodus of Since this was persons peripheral to and outside of the ten mile zone.

No good or public purpose is served by ignoring either the past experience or that which would predictably occur in the future.

There is no appeal process regarding the Director Decision except to appeal for a Commissioner-Level consideration and, thus, absent any other recourse, we believe this matter deserves and should receive review and consideration at the Commissioner-Level.

All emergency management planning in this region focuses exclusively on the ten mile radius zone.

Absent any planning that is inclusive of the population beyond this zone, it has been and remains our view that we are placing at risk the lives and portable property of literally thousands of residents and visitors outside of the TMI ten mile zone.

Since emergency management planning, to protect the health and safety of the public, is an exclusively government function, the NRC and its Commissioners and, subsequently, the state, county and municipal emergency management agencies, are duty-bound to anticipate, plan for and be prepared for those contingencies that we reasonably believe can or will occur in a major event. In this regard, it continues to be our firm belief that resources currently pledged to handle a ten mile zone evacuation would be seriously inadequate, overburdened and surcharged by any actual evacuation occurrence.

For the aforementioned reasons, we believe there is significant merit to a Commissioner-Level consideration of this matter.
