Dear Commissioner Selin,

I write on behalf of Mr. Robert Gary, a representative for the Pennsylvania Institute for Clean Air (PICA).

Mr. Gary and his organization are concerned about the evacuation zone l

surrounding the nuclear power plant at Three Mile Island in Middletown, Pennsylvania.

Earlier this month, the NRC staff denied PICA's request to extend the evacuation zone around Three Mile Island to include i

Harrisburg, Pennsylvania, and other highly populated areas outside of the ten mile radius required by current regulation.

i PICA questions the present regulations regarding the evacuation zone, and would like you to re-review the NRC Director's decision about the PICA petition.

As you know, two years ago PICA filed a petition with the Nuclear

)

Regulatory Commission to extend the evacuation zone around the nuclear power plant at Three Mile Island to include the citizens of Harrisburg Pennsylvania and other high density population areas just beyond the ten mile radius.

j Today the NRC Directors denied PICA's request pointing out that the ten mile radius is in compliance with the regulation calling j

for a ten mile radius which was made in the 1970's. PICA has l

known since the day it filed its request that the ten mile radius I

is in compliance with the regulation calling for a ten mile radius. We were guestioning that regulation.

l Now we question whether the NRC is ready to perform any part of its integral basic responsibilities that are intrinsic to its holding a Commission as an Agency of the U.S.

government. These basic responsibilities include safeguarding the health and safety of American citizens from the hazards that may arise from our nuclear reactor program as regulated by the NRC.

Since the 1970's two things have happened which may have bearing on the adequacy of the ten mile radius. First, Chernobyl melted down and contaminated most of Russia, and much of Europe. Second, TMI Unit Two was opened up and it was found that core temperatures during the 1979 accident reached 5100 F degrees, and 30 tons of fuel was melted. The National Three Mile Island Network says they have an affidavit from Admiral Hyman Rickover's daughter-in-law saying that he had persuaded President Jimmy Carter to suooress the most alarmino asoccts of the Kemenv Commission ReDort.

Under these circumstances it is not unreasonable that citizens may wish to re-examine the 10 mile radius decisiQD that was made in the 1970's. PICA calls for: (1) the Commissioners to review the Director's Decision and we ask for your support on that. If the Commissioners decide to retain the 10 mile radius, we call for (2) a Conoressional Investication, and we ask for your support on that.
