i ENCLOSURE 1 NOTICE OF VIOLATION Babcock and Wilcox Company Docket No.70-824 Lynchburg Technology Center License No. SNM-778 During an NRC inspection conducted on March 24 - 25, 1994, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," the violation is listed below:
Condition S-1 of Special Nuclear Material License No. SNM-778, requires use of SNM to be in accordance with the statements, represeniations, and conditions of Chapters 1 thru 8 of the license application dated November 26, 1985, and supplements dated May 27 and June 19, 1986; January 20, January 29, April 27, May 26, August 10, September 1, and December 8, 1987; March 30, June 14, and June 20, 1988; March 31, May 19, and July 17, 1989; July 17, 1990; May 14, 1992; and February 1 and March 31, 1993.
Chapter 2, Section 2.7.1.1 specifies that all operations with licensed material shall be conducted in accordance with Area Operating Procedures or Radiation Work Permits.
Area Operating Procedure, B-GP-3, Receipt of Radioactive Materials, Revision 7, dated November, 1993, requires, for receipt of radioactive material after normal working hours, that the B&W Naval Nuclear Fuels Division (NNFD) security force be in possession of a call list of whom to call and notify of the receipt.
Contrary to the above, on March 22, 1994, the Naval Nuclear fuels Division night shift security force members were not in possession of the call list, were not aware of the shipment's scheduled arrival, and consequently caused the shipment to be delivered to the B&W Commercial Nuclear Fuel Plant.
This is a Severity Level IV violation (Supplement III).
Pursuant to the provisions of 10 CFR 2.201, Babcock and Wilcox is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
This reply shoula be clearly marked as a " Reply to a Notice of Violation" and should include: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violat' ions, and (4) the date when full compliance will be achieved.
