.at ENCLOSURE 1 NOTICE OF VIOLATION General Electric Company Docket No. 70-1113 Wilimington facility License No. SNM-1097 During an NRC inspection conducted on February-4-8, 1991, violations of NRC requirements were identified.

In accordance with the " General Statement of Polic and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990, the violations'are listed below:

A.

License Condition Number (No,) 9 of Special Nuclear Material (SNM) License No.1097 requires that licensed material be used in accordance with statements, representations, and conditions of Part I of the License Application.

Part 1, Section 2.7.1 of the licensee's Application for License No.

SNM-1097 requires that radiation protection function activities be conducted in accordance with written procedures.

Nuclear Safety Release / Requirements-Process Requirements and Operators Document (PROD) 87.01, Controlled Access Area General Requirements, Revision (Rev.) 0, dated September 14, 1990, requires personnel assigned TLD badges to wear the badges at all times when in the Bundle Assembly area.

Nuclear Safety Instruction (NSI) No. 0-2.0, Bioassay-Urimlysis Program, Rev.18 dated March 7,1990, requires workers in the Uranium Recovery Unit (URU), and the Chemet and URV labs to submit urine samples for testing at the end of shift on the last day of the work week and also on Sunday of the wurk-week.

Workers in the Vaporization and Hydrolysis areas are required to submit urine samples at the end of shift each work day.

Contrary to the above, the licensee failed to follow radiation protection monitoring procedures for the following examples.

1.

On February 5,1991 a Quality Control _ worker failed to wear proper dosimetry during work in the Bundle Assembly area.

2.

For the period January 1-31, 1991, bioassay records indicated the.t urinalysis samples were not submitted as - requircd in that on9 Vaporization and three URU area workers failed to submit urine samples at the end of shift (within two hours prior to the end of l

License No. SNM-1097 the required sample time) on six occasior.s, and in addition, three URV workers feiled to submit urine samplas on the last day and/or on Sunday of the work week on four occasians.

Example 1 1 is a repeat ~ violation.

These examples are considered collectively as a Severity _ Level IV violation (Supplement IV),

License Condition' No. 9 of SNM License No.1097 requires that licensed material be-used in accordance with statements, representations, and conditions of Part I of the License Application.

Part 1, Section 4.1.3 of the licensee's Application for License _ No.

SNM-1097 requires that -criticality control procedures incorporating-limitations established by the criticality safety function are developed and maintained and that-concerned personnel are cade aware of these procedures _through posting, training programs or other appropriate written notifications.

" Nuclear Safety Release Requirement (NSR/R) procedure, 2.01.01, UPNP General General,-Revision 2, dated March 19, 1990,. requires that fissile material may only be left unattended in approved storage locations.

Contrary to the above, the licensee failed to follow criticality control procedures-in that for an approximate 12 hour1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> period during February 5-6, 1991, an unattended five gallon approved container holding-an estimated pint of process liquid containing fissile material was suspended from a drain -line valve located-on second floor of the URV solvent extraction process area, an unapproved storage location.

This is a Severity Level IV violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, General Electric Company is hereby required to submit a written statement or ex)lanation -to the U.S. Nuclear Regulatory. Commission, ATTN:- Document Control Desk, Washington, D.C. 20555 with a copy to the _ Regional Administrator, Region II, and if applicable, a copy to the NRC Resident inspector, within 30 days of the date of the letter

' transmitting this Notice of. Violation (Notice).

This reply should be clearly marked as a " Reply ~ to a Notice of Violation" and should include for each violation: -(1) the_ reason for-the violation,- or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken-and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and- (4) the date when full compliance will be achieved.

If an adequate reply 'is not received within the time specified in this Notice, an order may be issued' to show cause why the license should not be modified,

License No. SNM-1097 suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to 0xtending the response time.
