Th'is re.fers - to the -inspection conducted by - G'. B. Kuro of this office on February-4-8, 1991. -The inspectlan-included a review of activities authorized for your Wilmington facility.

At the conclusion of the: inspection, the -

findings were -discussed with those members of your staff identified iri the Ereport.

Areas examined during the inspection are identified in the report.

Within these areas,:the inspection consisted of selective examinations of procedures and f representative records, _ interviews. with personnel, and observhtion of

activities.in progress.

Base'd on the results of this inspection, certain of your activities appeared to

' bet in violation of HRC requirements, as specified in the enclosed Notice of x

Violation *(NUtice).. We are concerned about the violations because the failure to follow ~ radiation monitoring procedures may result in improperly assessed or 1

-unnecessary personnel exposure and the failure to follow criticality procedures may result in' a! criticality scenario not previously assessed by your safety evaluation:;.

For these NRC-identified violations, selective corrective actions were. initiated _during the onsite inspectior,.

Example 14 of Violation A described-in the enclosed Notice is similar to a

" violation - sent to - you by - our letter dated November 2,1990.

As we have i

discussed' on several occasions in the past, recurring violations are of i

particular concern because the NRC expects licensees to learn from their past

~!

failures and to takelefftctive corrective actions.

Although NRC does not normally -consider monetary civil penalties for Severity Level IV violations,

}

the~ Enforcement Policy states that such penalties _may be imposed for Severity Leve1TIV violations that;are similar to previous violations 'for which the

-licensee did not. takeLeffective corrective action.

-In this case, we have decided not to-pursue escalated enforcement activities because of the isolated nature regarding the issue: and the implementation of your cc.npliance improvement programs outlined during an Enforcement Conference held on August 27, 1990, Id

and documented in a letter to you dated No> ember 2, 1990.

We will continue to monitor closely your progress in all radiation protection program areas.

In accordance with 10 CFR 2.790(a), a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
