ENCLOSURE 1 NOTICE OF VIOLATION Virginia Electric and Power Company Docket Nos. 50-338, 50-339 North Anna Power Station

' License Nos. NPF-4, NPF-7 During-an NRC inspection conducted on February 4-8, 1991, violations of-NRC requirements were identified.

In accordance with the " General Statement of a

Policy 'and Procedure for.NRC Enforcenient Actions," 10 CFR Part 2. Appendix C (1990), the violations are listed below:

A.

10 CFR 20.311 (b) requires each shipment of radioactive waste to a. land disposal facility be accompanied by e shipment manifest that indicates-as

_ completely as practicable; a physical description.of the waste;- the volume;:radionuclide identity and quantity; the total radioactivity; and zg'.

- Contrary to the above, on August 9,1990 'the licensee underestimated the -

correct radioactivi.ty Jon the shipment manifest for. radioactive waste shipment 90-11.- The shipping manifest or.iginally. reported the total as 70.7 curies when the actual radioactivity.was-232 curies.

- This-is a. Severity Level IV violation (Supplement V).

Corrective: actions for Violation A above have been completed and the actions reviewed by NRC representatives.-

Technical Specification 3/4.7.11 requires that each sealed source in use contai wg radioactive niaterial in excess of 100 microcuries of beta and/or gamma emitting material or five microcuries of alpha emitting l

material be tested for leakage and/or contamination at least once per six months.

For stored sources not in use, the Technieri Specification requires that each sealed source be tested prior to use.

Contrary to the aLove, the licensee failed to test for leak 6pe a Victoreen High Range Field calibrator containing a 250 millicurie Cs-137 source during the pericd between June 11,19E7 and February 6,1991, when the calibrator was used on at least seven occasions.

This is a Severity level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, Virginia Electric and Power Company is hereby required to submit a written statement or explanation to the U.S.

Nuclear Regulatory Conmission, ATTN:

Document Control Desk, Washington, D.C.

20555 with a copy to the Regional Administrator, Region II, and if applicable, a copy to the NRC Resident inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a " Reply to a Notice of Violation" and snould include for Violation B:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3 the corrective steps that will be taken to avoid furtner violations, and (4) )the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
