SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT N05. 50-338/91-05 AND 50-339/91-05)

This refers to the inspection conducted by W. B. Gloersn and others of this

office on February 4-6, 1991.

The _ inspection included i 'eview of activities

authorized for your North Anna facility, At the conclus!oi of the inspection,

the findings were discussed with those rnembers of your st:df identified in the

report.

Areas examined during the inspection are identified ir> the ) eport.

Within

-

these areas, the inspection consisted of selective ex5minatiens of procedures

and regesentative records, interviews with personne., tnd observation of

activities in progress.

Based on the results of this inspection, certain of your a:Vivities appeared to

be in violation of NRC requirements, as specified in the erclosed Notice of

Violation.

We are concerned about the Violation A becaus e of the possibility

of significant failure to identify the correct quantity of radioactive material

in a radwaste shipment.

Although this violation was licer,sce-iientified, the

citation is being issued since the corrective actions to trevent recurrence

were inadequate.

In addition, we are concerned about Violation B because of

the possibility of not detecting sealed source contamination t.hile sealed

sources are in use.

You are required to respond to this letter and should fo11cw tie instructions

specified in the enclosed Notice when preparing your re monte.

In your response,

you should document the specific actions taken and any addli cs1 actions you

plan to -prevent recurrence.

After reviewing your responsr. 10 this Notice,

including your proposed corrective actions and the result cf future inspections,

the NRC will determine whether further NRC enforcement actirn is necessary to

ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790(a), a copy of this letter and its enclosure

will be placed in the NRC Public Jocument Room.-

The responses directed by this letter and its enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, PL 96-511.
