Dear Mr. Sholly:

This is in partial response to your letter dated November 2,1982, in which you requested, pursuant to the Freedom of Information Act, 22 categories of documents which you identified in your letter.

On December 8, 1982, a meeting was held to discuss the documents requested in your letter.

Those in attendance at this meeting were Mr. John C. Carr and Ms. Nina L. Toms of my staff, and Mr. Roger Blond of the Office of Nuclear Regulatory Research.

As a result of this meeting, it was agreed that the documents listed on Appendix A are responsive to your request.

A copy of these documents are being placed in the NRC Public Document Room (PDR), 1717 H Street, N.W., Washington, DC 20555.

The documents listed on Appendix B are being withheld in their entirety.

Without exception, they are predecisional documents exempt from mandatory public disclosure pursuant to the deliberative process privilege of Exempi. ion 5 of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and the Commission's regulations (10 CFR 9.5(a)(5)).

These documents represent NRC staff interaction in the preparation of draft testimony generated at the direction of NRC hearing attorneys for the Indian Point Hearings.

These documents represent attorney work product.

The factual portions, if any, of these documents are inextricably intertwined with advice, opinions, and recommendations.

Thus, there are no reasonably segregable portions of these documents subject to release.

Pursuant to 10 CFR 9.15 of the Commissions regulations, it has been deter-mined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest.
