Dear Dr. Clayton:
By letter dated August 31,1982,' Mr. Philip Loretan requested authorization to dismantle your AGN-201 reactor (License No. R-122), and stated your w'Ges on certain other items. Regarding the request for authorization to dismantle, it is our understanding that the fuel-for your reactor was not actually loaded
'into the reactor Mhile.it was at your institute, so at no time did you have an assembled operating reactor. Furthermore, in accordance with Operating License No. R-122 and the applicable regulations, you have already shipped the reactor fuel to the Department of Energy (DOE). Therefore, you may file a joint request to the Nuclear Regulatory Consission (NRC) for authorization to dismantle and dispose of the reactor components, and for termination of your operating license. This request should be signed by the authorized person who administers the operating license at your facility, and submitted -
in accordance with the requiremsats of 10 CFR 50.82 and 10 CFR 50.30 (a) and-(b).
In addition to sending the formal request, you should take the following actions in order for us to proceed:
- 1) Obtain a license from the state of Alabama (an agreement state) authorizing you to possess the fission plate under their jurisdiction. 'You should contact Mr. A. Godwin, Director Division of Radiological Health, Environmental Health Administation, Room 314, State Office Building, Montgomery, Alabama 36130 for information about such a license. In addition, the requirements of 10 CFR 150 continue to apply in the case of an agreement state authorization. Until some other arrangements are made, License No. R-122 continues to be the NRC authorization for you to possess the fission plate. However, this does not replace the-necessary agree-ment you must have with DOE, presumably the owner of the special nuclear material.

- 2) Provide to my office a report of the results of measurements of the surface contamination of radioactivity and of the direct radiation from the rernaining reactor components and frots the room in which the reactor and the fuel have been located.
Please include information about the ambient background radiation levels.
The surveys of the radiation exposure rates should include the inside surfaces, as well as the outside surfaces, of the reactor components.
Regulatory Guide 1.86, " Termination of Operating Licenses for Nuclear Reactors", a copy of which is enc 50 sed, provides guidance on acceptable surface contamination.
In order that we can evaluate your measured results, please include information about the type of instruments used, their sensitivities, how and when last calibrated, and the methods you used to measure and evaluate the reactor-related radiation fields.
Since you made a timely submittal of an emergency plan, no action by HRC is required on your request for an exemption to the requirement of 50.54(r).
