APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Docket No.

50-220 Nine Mile Point Unit 1 License No. DPR-63 As a result of the inspection conducted on October 26 through 29, 1982 and in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 47 FR 9987 (March 9,1982) the following violation was identified:

10 CFR Part 50, Appendix B, Criterion IX requires that nondestructive testing be accomplished in accordance with applicable codes. The welding procedure number 1399-K-W001 for recirculation loop pipe and safe end welding requires the use of ASME Section III for Class 1 components.

The ASME Code,Section III, parts NB 5111 and NB 5221 require that radiography of Class I weld joints be in accordance with the ASME Code,Section V, Article 2. Article 2 of ASME Section V, paragraph T-236 requires permanent identification on each radiograph traceable to the component and weld seam as appropriate.

Paragraph 8.1 of the NES Radiographic Procedure Number 80A6457 requires that each radiograph be permanently traceable to the correct plant, system and weld.

Contrary to the above, on October 29, 1982 three radiographs approved for the weld number FW12S-SEN were not permanently traceable to the correct system and weld but were clearly misidentified as FW 11S-SEN.

This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Corporation is I

hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) correc-tive steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consider-ation will be given to extending this response time.
