Mr. Henry D. Hukill Vice President GPU Huclear Corporation 1

P. O. Box 480 Middletown, Pennsylvania 17057

Dear Mr. Hukill:

SUBJECT:

APPLICATION FOR WITHHOLDING INFORMATION FROM FUBLIC DISCLOSURE By letter dated August 20, 1932, you submitted the "TMI-1 Steam Generator Repair Safety Evaluation". You have requested that infor-nation in certain Sections, paragraphs and figures of the report be withheld from public disclosure pursuant to 10 CFR Section 2.790.

The withholding request is supported by affidavit signed by fir. James H.

Taylor of B&W dated August 18, 1982. Subsequently, you submitted a revision to this report by letter dated October 5,1982 supported by the same affidavit.

B&W maintains that the document contains infomation of the type customarily held in confidence by them and that such information is not available in open literature and is not known by potential competitors of B&W. B&W also states that the information reveals test results and analyses concerning steam generator repair procedures which secure competitive economic advantage to B&W and its subcontractor Foster Wheeler. B&W believes that disclosure of this information would reduce the expenditure of their competitors and, thus, would harm the competitive position of B&W and Foster Wheeler.

1 We have reviewed the application and related material based on the requirements and criteria of 10 CFR 2.790 and have detemined that this report contains proprietary comercial infomation.

We have also found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the denonstrated concern for protection of B&W's competitive position. Accordingly, we have determined that the applicable infomation should be withheld from public disclosure.

We, therefore, approve the request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding from public inspection the above mentioned document.

1 Mr. llenry D. Ilukill Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the document. If the need arises, we may send copies of this infomation to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handling proprietary data.

If the basis for withholding this infomation from public inspection should change in the future such that the information could then be made available for public inspection, you or B&W should promptly notify the NRC.

Sincerely, Mi signed my John F. Stolz, Chief Operating Reactors Branch #4 Division of Licensing cc:
