Dear Dr. Wilson:
This is in response to your letter of September 21, 1982 in which you addressed a number of inquiries to me. Your first inquiry related to SECY 82-111. This document, dated March 11, 1982, was a NRC Staff paper to the Commission requesting Commission approval of 1) of a set of basic require-ments for emergency response capability and 2) the Staff's proposal that it work with licensees to develop plant specific implementation schedules. One of the areas of emergency response capability identified in the document related to Control Room Design Review. On July 16, 1982, the Commission approved SECY 82-111, subject to certain modifications. The Comission's approval resulted in the need for the Staff to issue certain documents. The Staff has prepared those documents and is seeking Commission approval of the documents and approval to issue them. The matter is currently pending before the Commission. Thus, in answer to your specific question, the Commission has not taken the action which Applicant, in its June 1, 1982 letter, indicates it is awaiting before proceeding further in conducting a Control Room Design Review.
Your second inquiry related to the August 9, 1982 meeting notice issued by the Staff. That meeting subsequently was cancelled. The Staff's general practice is to prepare a brief written summary of meetings it holds, and to attach any documents distributed at the meeting to the summary. The meeting summary is filed with the Comission's public document rooms. Since you have been admitted an Intervenor to this proceeding, in the future you will receive meeting notices issued by the Staff and a copy of the meeting summary. Lastly, Mr. Schrieber is an expert in hydrology who has been retained as a consultant to the Staff.

. 1 Finally, you inquired what relationship is permissible between yourself and the members of the NRC Staff. As an intervenor, you have the rights and responsibilities of a party in a Commission proceeding, including those relating to discovery. The Commission's Regulations concerning discovery are set forth in 10 C.F.R. 59 2.740-2.744.
I am enclosing a copy of these regulations. Your discovery requests must be directed to me as counsel for the Staff. They should be limited to matters which are relevant to your admitted contentions, or to those matters which may lead to information which is relevant to your admitted contentions. To answer your specific questions, since we are separate parties to a legal proceeding, the usual practice is for there to be no direct technical staff-intervenor discussions except as may be scheduled through Staff counsel. Thus, it would not be appropriate for you to call Mr. Westcott to discuss the staff analysis of the reservoir or a technical staff member in the Quality Assurance Branch to inquire generally about Quality Assurance programs at reactors in other parts of the country.
