Gentlemen:
~HSmith By letter dated February 14, 1978, you transmitted proprietary infomc-tion related to the proposed High Density Fuel Storage System at the fionticello Huclear Generating Plant. General Electric Company (GE) provided a proprietary affidavit by Lyle L. Zahn, Jr., dated February 6, 1978 in support of withholding the pmprietary information from public -
disclosure pursuant to 10 CFR 2.790.

Genercl. Electric Company's reasons for requesting our withholding were:
the.information contained in the document has been classified pro-prietary because it. contains informtion valuable to product design that was obtained at considerable expense to GE; the information is not availabic in open literature and has consistently been held in con-fidence by GE and no public disclosure of it has been made; all dis-3 closures to third parties have been made pursuant to regulatory pro-visions of preprietary agreements which provide for maintenance of the infomation in confidence; public disclosure of the information is likely to cause substantial ham to the competitive position of GE and deprive or reduce the availability of profit making opportunities since the infomation is a portion of that developed with the expenditure of substantial resources; and release of this infomation~ to the public would jeopardize GE's competitive status by enabling competitors to sell HDFSS design at prices not reflecting similar expenditums, thereby providing them a competitive advantage.
W have reviewed your submittal and GE's affidavit based on the require-rents and criteria of 10 CFR 2.793 and have determined that the above-mentioned documents contain trade secrets or proprietary comercial information. We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protec-tion of your competitive position. Accordingly, we have determined that the infemation should be withheld from public disclosure. ~
