REPORT NO. 50-389/83-26

This refers to the special safety inspection conducted by Mr. B. R. Crowley of

this office on March 29 - April 2,1983, of activities authorized by NRC

Construction Permit No. CPPR-144 for the St. Lucie facility. Our preliminary

findings were discussed with Mr. B. J. Escue, Site Manager, at the conclusion of

the inspection.

Areas examined during the inspection and our findings are discussed in the

enclosed inspection report. Within these areas, the inspection consisted of

selective examinations of procedures and representative records, interviews with

personnel, and observations by the inspector.

During the inspection, it was found that certain activities under your license

appear to violate NRC requirements. This item and references to pertinent

requirements are listed in the Notice of Violation enclosed herewith as

Appendix A.

Elements to be included in your response are delineated in

Appendix A.

We have examined actions you have taken with regard to previously identified

enforcement matters. These are discussed in the enclosed inspection report.

The NRC is concerned that actions taken by FP&L in response to a Notice of

Violation sent to you on September 29, 1982, regarding inadequate measures to

control welding and nondestructive testing of welds, were insufficient to pre-

clude further noncompliance in the same functional area. You are requested

to describe the additional measures you have taken or will take to resolve this

issue. Failure to correct this deficient implementation of corrective action

may result, if repeated in further enforcement action.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosures will

be placed in the NRC's Public Document Room unless you notify this office, by

telephone, within ten days of the date of this letter and submit written applica-

tion to withhold information contained therein within thirty days of the date of

this letter. Such application must be consistent with the requirements of

2.790(b)(1).

The responses directed by this letter and the enclosures are not subject to the

clearance procedures of-the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, PL 96-511.
