SUBJECT:

EXTENSION OF SPECIAL NUCLEAR MATERIALS LICENSE NO. SNM-1050 I.

Background

Dy letter dr.ted March 23, 1983, the University of Florida (UF) requested an extension of the expiration date for Special Nuclear Materials License No. SNM-1050, to July 31, 1984. The previous extension, dated May 26, 1981, was granted to allow the licensee time to prepare a consolidated application, combining Materials License Nos. SNM-50 and SNM-1050. The licensee had requested consolidation to be relieved of preparing redundant applications and of meeting dual expiration dates; however, UF has infomed us that they now wish to keep the licenses separate. License No. SNH-1050 currently authorizes the possession and use of 190 kg of U-235 contained in SPERT fuel rods in a subcritical assembly.

II. Discussion As reported by Dr. Diaz the UF SPERT assembly is being reviewed for design, structure, equipment and utilization because it is almost 20 years old.

During the review period, the fuel is stored in safe configuration in a secured room of concrete block construction, which was approved and authorized by Amendment No. 4 to this license, dated May 26,1981. Currently, UF has no specified use for the fuel rods and cannot submit an application as requested.

The use specifications as stated in Condition 8 of this license are no longer appropriate; therefore, modification of that condition to authorize storage only is recommended as follows:

Condition No. 8 For storage only in accordance with the statements, representations and conditions specified in Items 2(a), (b), and (d) of the licensee's letter dated July 15, 1980.

This has been discussed with and agreed to by the licensee and the Region II Inspector, Robert Brown. As discussed with Mr. Brown, the fuel as stored minimizes any potential for adverse safety effects for UF personnel, the public, and/or the environment.
