Gentlemen:

This refers to the NRC's Systematic Assessment of Licensee Performance (SALP)

of the Donald C. Cook, Units 1 and 2 and our meeting of June 22, 1983, to

review the results of that assessment covering the period April 1, 1982,

through March 31, 1983. A copy of the SALP 3 Report was provided for your

review in advance of the meeting.

Enclosed is the final SALP 3 Report that

incorporates the SALP Board Chairman's letter to you and your letter of

June 29, 1983.

In addition to the assessments and recommendations made by the SALP Board

contained in the enclosed SALP Report, I wish to give you my overall observa-

tions and assessment relative to the utility's regulatory performance during

the assessment period.

First, while the overall regulatory performance at the Donald C. Cook Nuclear

Power Plant was satisfactory, there appears to be a lack of significant regula-

tory improvement, especially in the area of quality assurance / quality control.

I fully support the recommendations of the SALP Board noted in Enclosure 1

which point to the need to devote sufficient manpower and resources to fully

implement the Regulatory Performance Improvement Program in a timely and

effective manner.

It is a matter of concern to me that of three utilities

in Region III involved in regulatory performance improvement programs, the

Donald C. Cook program took the longest to develop and implement.

Secondly, in regards to the comments in your June 29, 1983, letter concerning

plant operations, I wish to commend you for the improvements which you have

made in this area.

It appears the management controls in this area have been

strengthened significantly. The information provided in your letter concerning

consecutive days of operation and unit availability factors was available to us

at the time the rating in this area was determined, even though it was not men-

tioned in the report. We have reviewed our findings again in view of your

request for consideration of a higher rating in this area. We have concluded

that the overall performance is properly rated principally because of the

noncompliance identified in this area. You should recognize that each cate-

gory encompasses a fairly broad span of performance, and we acknowledge

improvement in the area even though the category remains the same.

Corrections to the SALP Report are included in the Report Errata Sheet. The

four additional noncompliances shown in the Errata Sheet were discussed with

you at the SALP meeting. These were contained in a report covering an inspec-

tion conducted near the end of the assessment period, but which was not issued

until after the initial SALP Report was written. These additional noncom-

pliances do not change any category ratings.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and the SALP

Report will be placed in the NRC's Public Document Room.

No reply to this letter is required; however, should you have any questions

concerning these matters, we will be pleased to discuss them with you.
