By letter dated March 15, 1983, theDivisionofLicensing(DL) staff approved your application dated February 23, 1983, for. exemption from certain fire protection schedular requirements for the Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2.

AClassIIIfee($4,000)and a Class I fee ($400) were remitted with your request pursuant to 10 CFR 170.22.

l It is currently NRC policy to exempt from fees those requests that are approved pursuant to 10 CFR 50.12 in cases where no license amendment is issued or there is no other provision in the regulation that pro-videsfortherelieforexemption(e.g.,50.55(a)(g)). Since your February 23 application was approved pursuant to 10 CFR 50.12, we have concluded that an exemption, pursuant to 10 CFR 170.11(b), from the fee requirement is authorized by law and such exemption is otherwise in the public interest and is hereby granted for it. Consequently, a refund of $4,400 is applicable.

On September 27, 1982, the DL staff approved the alternate safe shutdown

portion of your March 19,1981 application (as supplemented through Sep-l

tend >er 7,1982). Fees pursuant to 10 CFR 170.22 were not remitted with i

this application. While it is NRC policy not to charge for those portions l

approved pursuant to 10 CFR 50.12 on May 10 and August 16, 1982, fees are l

being assessed for the review of the alternate safe shutdown review. Based l

on information provided by the DL staff as a result of the final review of the alternate safe shutdown data, it has been determined that a Class III fee of $4,000 and a Class I fee of $400 are appropriate for this item since

the review involved a single safety issue and a duplicate unit.
