Dear Mr. DeYoung:
By letter dated May 5,1983, you transmitted to the Licensee, Public Service Electric and Gas Campany, et al, a " Notice of Violation and Proposed Imposition of Civil Penalties" in the captioned matter. The notice provided, inter alia, that pursuant to the provisions of 10 C.F.R. Section 2.201, the Licensee is i
required to submit its response to your office within 30 days of the date of the notice. The letter also specified that consideration would be given to extending the response time for good cause shown.
The purpose of this letter is to request that the time for responding to i
the notice be ex' ended 30 days. As you are aware, the civil penalty proposed by i
the NRC on May 5,1983 is the largest to date for any facility. The additional time is needed becatase of the complexity of the issues involved which is requiring extensive review of factual and legal issues and consideration of the available options as stated in the notice. The notice includes three categories of violations and associated penalties, with several subcategories, at Severity Levels I, II and III, any one of which would alone involve intensive review by the Licensee and l
consideration of alternative courses of action.
Since receipt of' the notice, the Licensee has been making diligent efforts to complete its review and analysis of the available information to respond to the allegations. Much of this information was previously available and has been shared with the Staff and Commission resulting in the intensive Staff investigation documented in NUREG-0977, "NRC Fact-Finding Task Force Report on the ATWS Events at Salem Nuclear Generating Station Unit 1, on February 22 and 25,1983."
In addition, new inbemation which may bear on the response has recently become available, such as NUREG-1000, " Generic Implications of ATWS Events at the i
