Dear Senator Domenici:
Reference is made to your letter to Chairman Ahearne of January 9,1980, in which you made inquiries relative to a pending administrative action regarding one of your constituents, Nuclear Pharmacy, Incorporated (NPI). As you are no doubt aware, the Department of Justice (D0J) is currently reviewing material involving NPI. DOJ's review involves facts which surfaced during an NP.C inspection of one of NPI's facilities. At the request of the D0J we have deferred completion of proposed formal enforcement action until D0J can complete its review of our referral. Since your inquiry specifically relates to matters which D0J is reviewing, D0J will respond to you directly. Please be advised, that in the interim, no operating restrictions have been placed upon NPI, other than the requirement that it comply with the NRC regulations and the conditions of its NRC licenses.
