Issuance of Anendment No. 5 to Facility Operating License No. DPR-76 (Diablo Canyon Nuclear Power Plant, Unit 1)
By letter dated January 6,1983 the NRC issued Amendment No. 3, and its supporting i
Safety Evaluation, to Facility Operating License No. DRP-76 for the Diablo Canyon Nuclear Power Plant, Unit 1.
Anendment No. 3 authorized relief from Section 3/4.9.7 of the Diablo Canyon Technical Specifications for a period of 120 days in order to install steel covers over the Diablo Canyon, Unit I spent fuel pool to prevent an object fron falling en and possibly damaging the stored unirradiated new fuel assenblies and nake certain modifications in the Fuel Handling Building. The relief period granted was' fron January 6,1983 through May 6, 1983.
In your letter of April 29, 1983 you requested relief for an additional period of 45 days to complete the nodifications within the Fuel Handling Building.
you further stated that the conditions, requirements, and procedures applicable to Acendnent No. 3 will remain in effect fd the requested period of extension.
Based on our previous evaluation, as delineated in our Safety Evaluation issued with Anend:acnt No. 3, we find that our previous conclusions on this matter remain valid and are directly applicable to your request for an extension for relief for an additional 45 days. We therefore approve your request for relief and i+ is hereby extended fron May 6,1983 to June 20, 1983.
In this regard, the Connission has issued the enclosed Anendment No. S to Facility Operating License No. DPR-76.
i We have determined that the amendment does not authorize a change in effluent types or total amounts nor an increase in power level and will not result in any significant environnental inpact. Having nade this determination, we have further concluded that the amendment involves an action which is insignificant from the standpoint of environnental impact and, pursuant to 10 CFR Section 51.5(d)(4), that an environnental inpact statement or negative declaration and environnental impact apprasial need not be prepared in connection with the issuance of this amendnent.

(1) because the amendment does.not involve a significant increase in the probability or consequences of ' accidents previously cons 19 red and does not involve' a significant decrease in a safety margin, the amendment.does not involve a significant hazards consideration,' (2) there. is reasonable assurance that the health and safety of the public will not be endangered by operation in' the proposed manner, and (3) such activities will-be conducted in compliance with the Coretission's regulations and the issuance of this amendment will not be inimical' to the common defense and security or to the health and safety of the public.
