Wisconsin Electric Power Company 1
ATTH: Mr.C. W. Fay Vice President - Nuclear i
Power 231 West Michigan Street Milwaukee, Wisconsin 53201 i
Gentlemen:
~
We have received a copy of your application dated Mar:h 24, 1983, which was filed with the Office of Nuclear Reactor Regulation (0NRR) for review.
This application proposed certain Technical Specification changes relating to auxiliary feedwater system operability at the Point Beach Nuclear Plant.
Unit Nos. I and 2.
Fees pursuant to 10 CFR 170.22 were not remitted with your application because you requested to be notified of the appropriate fee if the NRR staff consider a change to the Technical Specifications to be necessary.
I A
Based on information provided by the ONRR staff as the result of their pre-liminary review of your application, it has been determined that Technical Specification changes are necessary and that a Class III fee ($4,000) and
+
1 a Class I fee ($400) are appropriate for this request since the review will involve consideration of a single safety issue and a duplicata unit. There-fore, a total of $4,400 is due for it.
On another matter, we have noted that your Company paid two duplicate Class I 1
fees ($800) for your application dated September 26, 1979, for miscellaneous administrative changes and organizational structure changes. Since that time, we have learned that Point Beach, Unit Nos. I and 2 share a commen set of Technical Specifications. Since the issuance of Amendment Nos. 43 and 48 on April 3,1980, approving the' September 26 application only involved a single administrative effort because of the commonality of the Technical Specifications, we have determined that a second duplicate Class I fee for 4
your September 26, 1979 application, is not appropriate. As a result, we j
have concluded that an eaemption pursuant to 10 CFR 170.11(b) from the fee requirements is authorized by law, and such exemption is otherwise in the public interest and is hereby granted for the second Class I duplicate fee i
remitted for your September 26,~1979 application.

. APR 2 7 1983 We are applying the $400 due your Company for the September 26 application to the $4,400 due the NRC for your March 24, 1983 application. Therefore, you are requested to remit the sum of $4,000 to this office. We hope this transaction meets with your approval.
If the ONRR staff's final analysis of your March 24 application reveals that the Classes III and I fees are not correct, you will be notified and any necessary adjustments will be made.
Sincerely.
