Dear Administrative Judges:

l In accordance with the schedule adopted by the Board for the hearing session commencing May 16, 1983, the Staff has enclosed its direct t

testimony (Enclosure 1) to be presented at that hearing session.

To address the concerns raised by Messrs. Walsh and Doyle, the Staff will present as a panel of witnesses Messrs. W. Paul Chen, Joseph I. Tapia, Robert G. Taylor, Jai N. Rajan, and Spottswcod Bumell. Messrs. Chen, Tapia, and Taylor have previously testified at previous hearing sessions.

These Staff witnesses will be prepared to answer Board questions regarding the Walsh/Doyle concerns at the forthcoming hearing session. The written testimony of these witnesses is enclosed. They will present the enclosed testimony, as well as their testimony pre-filed on March 30, 1983. The enclosed testimony and the testimony pre-filed in March replace the September j

1982 testimony of Messrs. Chen and Tapia.

To address the purpose of the inspection of the CPSES facility by the NRC Comanche Peak Construction Appraisal Team (" CAT"), the NRC Staff will present Mr. A. B. Beach. His testimony is also enclosed. The Staff does not intend to present any testimony on the findings of the CAT inspection at the May 16, 1983 hearing session but intends to present that testimony at the currently scheduled June 1983 hearing session. The Staff intends 50-446/83-12 (" CAT Report")praisal Inspection Report to mark the Construction Ap 50-445/83-18, for identification at the May hearing session and to offer it into evidence at the June hearing session.

1 To respond to Board questions regarding emergency preparedness (including the matters identified by the Board in its March 9, 1983 Order), the Staff intend: to present two panels of witnesses. NRC Staff member Mr. David H.

Rohrer, and Thomas Urbanik II, shall be on one panel. Messrs. Albert Lookabaugh and John Benton of the Federal Emergency Management Agency

(" FEMA") shall be on the second panel. The testimony of these witnesses, to y be presented during the hearing session scheduled for May 16-May 20,1983,

y is enclosed. Messrs. Rohrer, lookabaugh and Benton previously testified during the September 1982 hearing session.

In addition, Messrs. Rohrer and lookabaugh pre-filed testimony on March 30, 1983, which they will present at the May hearing session. As the Staff noted in its March 30, 1983 letter to the Board, FEMA's Interim Findings for CPSES, which are attached to Messrs.

Lookabaugh's and Benton's written testimony, will be offered into evidence.

As the Staff also noted, it intends to offer into evidence the Safety Evaluation Report, Supplement 3, for CPSES ("SSER No. 3").

Also enclosed (Enclosure 2) are the affidavits of NRC Staff members in response to the questions posed by the Board during the conference call of April 7, 1983.

It is the Staff's understanding that the Board will review the Staff affidavits, together with those that may be filed by the Appli-cants, to detennine whether the Board's inquiries have been satisfactorily addressed. The Staff also understands that in the event that the Board desires to pursue these inquiries through questioning of witnesses, the Board will advise the Staff before the hearing so that the Staff can make i

arrangements to have the appropriate witnesses available.
