AMENDMENT 12 - APPROVAL OF PHYSICAL PROTECTION PLAN, REVISION 22 (ENTERPRISE PROJECT IDENTIFIER L-2019-DFA-0013), AND REVISED LICENSE APPLICATION CHAPTER 10, DECOMMISSIONING (ENTERPRISE PROJECT IDENTIFIER L-2019-DFA-0013)

Dear Mr. Freudenberger:

In accordance with your request dated July 22, 2019 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML19207A007), as supplemented by your letter dated September 17, 2019 (ADAMS Accession Number ML19268A078), and pursuant to Part 70 to Title 10 of the Code of Federal Regulations (10 CFR), Materials License SNM-124 is hereby amended to approve Revision 22 of the Nuclear Fuel Services, Inc. (NFS), Physical Protection Plan for the Protection of Category 1 High Enriched Uranium (Strategic Special Nuclear Material). The review of the U.S. Nuclear Regulatory Commission (NRC) staff is documented in the enclosed Safeguards Evaluation Report. Accordingly, Safety Condition SG-3.1 of Materials License SNM-124 has been revised to reflect the approved revision to the Physical Protection Plan. This letter concludes action on this application and Enterprise Project Identifier (EPID) L-2019-SPR-0005 is considered CLOSED.

Additionally, in accordance with your request dated October 2, 2019 (ADAMS Accession Number ML19288A062), and pursuant to 10 CFR Part 70, Materials License SNM-124 is hereby amended to also approve the updated financial assurance documents and Revision 6 to Chapter 10, Decommissioning, of the NFS license application. The review of the NRC staff is documented in the enclosed Safety Evaluation Report. Accordingly, Safety Condition S-1 of Materials License SNM-124 has been revised to reflect the approved revision to the license application. This letter concludes action on this application and EPID L-2019-DFA-0013 is considered CLOSED.

All other license conditions shall remain the same. The enclosures to this letter provide the amended Materials License SNM-124, the Safeguards Evaluation Report from the review of Revision 22 to the Physical Protection Plan, and the Safety Evaluation Report from the review of the updated financial assurance documents and Revision 6 to Chapter 10 of the NFS license application.

The letter transmitted contains Security-Related Information. When separated from Enclosure 2, this letter is decontrolled.
