IMPOSITION or CIVIL PENALTY - $37,500 By EN 89110 dated December 14 1989 the Conenission was notified of the intent ofOEtoissueaNoticeofViolationandProposedImpositionofCivilPtnaltyin the amount of $50,000 to Dule Power Company.
This action was based on the lictnsee's failure to tale adequate corrective action and determine the root cause of a turbine driven auxiliary feedwater pump overspeed event. The pump was declared operable following three successive failures without adequate understanding of the root cause.
The licensee responded to the Notice in a letter dated January 31, 1990. After

careful consi:leration of the licensee's response, the staff has concluded that the vio!ation did occur as set forth in the Notice of Violation and Proposed imposition of Civil Penalty. The original proposed civil ptnalty has been reduced by 25%, because of the licensee's corrective action following the event, full mitigation was not deemed appropriate because those corrective actions did not address the aspect of determining equipment operability af ter multiple test failures without assuring that the root cause was satisfactorily add,ressed.
Accordingly, an Order Imposing Civil Penalty in the amount of $37,500 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
