Water Releases to Indian Kill Reservoir on 9 Feb 90 Pursuant to our recent telephone discussions this correspondence outlines the events of February 9,

1990 when slightly contaminated water was released from our site to the Indian Kill Reservoir.

As background information, on February 8 - 9, 1990, the Cintichem site was experiencing heavy rainfall.

Our onsite 002 outfall to the Indian Kill Reservoir has been utilized to collect drainage water from parts of the site to be held up, analyzed for radioactivity, and released as appropriate as instructed by the USNRC, Region I since January 5, 1990.

From: January 5 to February 8, 1990 no rgdioactivity above natural background (less than approximately 10-o microcuries/ml) had been detected in the S-12 sampling location at the gate of the 002 outfall.

During the early morning hours of February 9, it became apparent that due-to the rapid rise of rainf all water at the gate at 002, we did not have enough time to both sample and analyze, prior to release S-12 water without the distinct possibility of _ water

. going. over the 002 dam.

We feared this rapid rise in - water i

level, without ' periodic releases might well - wash the dam out resulting in a complete loss of control of all water through the 002 outfall.

Therefore, based upon the information described in the above paragraph, a decision was made to sample and release S-12 water prior - to receiving the analysis for radioactivity to l

L prevent an impending. catastrophe at the 002 dam.

At approximately 0830 hours0.00961 days <br />0.231 hours <br />0.00137 weeks <br />3.15815e-4 months <br />, upon receipt of the first analysis of this water, we became aware that these three batches of water released from 002 were slightly radioactive.

No further releases were. made from 002 af ter_ detecting the radioactivity in S-12.

All water was - pumped to onsite holding tanks and processed to l

1ess than maximum permissible concentrations prior to release.

Water Releases to Indian Kill Reservoir on 9 Feb 90 March 1, 1990 Page 2 It is estimated that each of these single releases approximately three hours apart were about 10,000 gallons each which ranged in radioactivity of about 3.28 x 10-7 to 5.15 x 10-7 uCi/ml of I-131, 8.52 x 10-8 to 2.76 x 10-7 uCi/ml of I-133 and 8.97 x 10-6 i

to 1.32 x 10-5 uCi/ml of Na-24 (refer to attached data sheets).

i Although this radioactivity poses no hazard or health risk to the general public and has not been measured in any S-13 Indian Kill Reservoir water samples, our site SPDES permit does not a.uow any s

release of radioactively contaminated water to the reservoir.

It should also be noted that all of this radioactivity would be less than MPC by calculation, due to the total amount of water released to the reservoir from 002 during the 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> period from February 8 - 9.

This does not include the dilution by the Indian Kill Reservoir itself.

To help prevent a recurrence of this situation we are not intentionally releasing any water via 002 outfall.

Any held up S-12 water is analyzed and pumped out to our 001 outfall and/or stored / filtered as required on site prior to release pursuant to our internal procedures and to the NRC CAL requirements.

In closing, this letter will satisfy any written reporting requirements applicable to this situation.
