This- refers to~the in-office, inspection conducted by Mr. J. Furia and Mr. J.

Kottan of this of fice on January 19-29, 1990, of-activities. authorized by NRC

License Nos. DPR-21, DPR-65 and NPF-49, with respect to the circumstances

surrounding the shipment of underwater shearer / compactor equipment to the Duane

Palo, Iowa. Discussion of our findings was held

' Based on the results of this inspection, it appears that certain of'your

activities were not conducted in full. compliance with NRC requirements.-

Specifically,;on January 17, 1990 a shipment of an underwater shearer / compactor

.wasmadeonanopentransportvehIclefromtheMillstoneStationsitetothe-

Duane- Arnold Energy Center, where upon receipt on January 19, 1990, it was

determined that the maximum surface radiation level on the underwater.-

shearer /conipactor package was 300 millirem per hour. This is in excess of the

maximum allowable radiation level of 200 millirem per hour permitted under.U. S.

Department of Transportation regulations as set forth in 49 CFR 173.441(a) and

NRC regulations as set forth in 10 CFR 71.47.

Of concern to the NRC is your lack of control in this area which resulted in

failure to properly remove internal contamination from the material to be

shipped, to ensure that external radiation levels were maintained within

regulatory limits.

Based on the results of this inspection and the discussion between Mr. Steven

-Scace of your staff and Dr. Ronald R. Bellamy of this office on January 31,

has been scheduled for February 20, 1990 at 1:00 p.m.

The conference will

provide both of us-the opportunity to achieve a common understanding of the

facts associated with the incident, and also provide you the opportunity to

discuss any mitigating circumstances for the incident and your plans for

short-term and long-term corrective actions. The need for and the nature of-

appropriate enforcement actions for the apparent violation will be the subject

of separate correspondence at a later date.
