Gentlemen:

This refers to the inspection conducted by a team of HRC and NRC consultant

personnel during the period January 8-12, 1990, of activities authorized by NRC

Operating License DPR-40 for Fort Calhoun Station, and to the discussion of our

findings with you and other members of your staff at the conclusion of the

inspection.

Areas examined during the inspection included the implementation of the

commitments to the provisions of Regulatory Guide 1.97

"Postaccident

Monitoring Instrumentation." Within these areas, the inspection consisted of

,' -

selective examination of design documentation, procedures and representative

l

-records, interviews with personnel, and observations by the inspectors. The

-

inspection findings are documented in the enclosed inspection report.

During this inspection, it was found that certain of your activities, as

1.-

discussed in paragraphs 3.3.4 and 3.3.5 of the enclosed report, were in

violation of HRC requirements. Consequently, you are required to respond to

these violations, in writing, in accordance with the provisions of

Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of

Federal Regulations. Your response should be based on the specifics contained

'in the Notice of Violation enclosed with this letter.

In addition to the activities mentioned above, another activity was also found

to be in violation of NRC requirements. This activity related to the

environmental qualification of the reactor containment building sump

temperature instrumentation and is discussed in paragraph 3.1.6 of the enclosed

l'

report. However, 'n accordance with the provisions of Section V.C.1 of the

'

NRC's Enforcement Policy, no citation is being issued for this violation and no

written response is required.

The response directed by this letter and the accompanying Notice is not subject

to the clearance procedures of the Office of Management and Eudget as required

by the Paperwork Reduction Act of 1980, PL 96-511.
