NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-285/89-48).

This refers to the-inspection conducted October 12 through November 30, 1989, at the Fort Calhoun Station,'and to the discussion of'the results of this.
L inspection at an enforcement conference attended by Omaha Public Power District (OPPD) and:NRC officials in NRC's Arlington, Texas, office on

January 5,~1990. -The results of this inspection were previously provided to l
OPPD-in an inspection report dated December 18, 1989.
-l The enforcement conference was held to discuss two apparent violations. One 1
apparent violation,was related to the licensee's failure to com

.With respect to the apparent violation involving two inoperable CCW heat exchangers, the violation of the TS LCO has been clarsified at Severity Level IV-in accordance with the guidance provided in Appendix C~of.10.CFR Part 2, the
" General Statement of Policy,and Procedure for NRC Enforcement Actions." The y
' basis for this determination is-that OPPD was able, through an already existing ar.alysis, to provide sufficient evidence to indicate.that, even with two of y

four CCW heat exchangers inoperable, the CCW system was capable of performing b
.its intended safety function in a design basis accident (DBA) with river temperatureeless than 60*F. OPPD's evaluation indicated that with river.
temperatures:below 60 F, sufficient cooling capabilities were availab'le with j
two operable CCW heat exchangers.. The licensee also indicated that for; river temperatures requiring three CCW heat exchangers to meet the DBA design
- requirements, the normal CCW system operating configuration would have disclosed
!an: inoperable CCW heat exchanger. Nonetheless, the NRC's review of this event indicates that OPPD's program for work control in this instance contained
.c weaknesses. The root cause appeared to be that inadequate work control instructions.were provided to the-individuals involved in returning the equipment to service following abandonment of the maintenance activity. The.
f
-failure to provide adequate training was also identified by the licensee as a
-factor. As a result,.two CCW heat exchangers were concurrently inoperable j
for 6 days, resulting in the. failure to comply with the TS LCO.

,-e Omaha,Pubi k Power District o During the enforcement conference, OPPD provided the corrective actions to be taken to address the indicated weaknesses. The NRC concludes that OPPD has instituted the appropriate corrective actions to address this violation; therefore, no written response is required. The NRC will perform an inspection in the near future to verify that OPPD has adequately implemented the corrective actions identified during the enforcement conference and specified in Licensee EventReport(LER)89-020.
With respect to the apparent violation involving the prrparation of an inadequate 50.59 evaluation, the NRC notes that this apparent violation was identified by the licensee, the licensee performed an evaluation to determine the root cause of the violation, and the licensee initiated implementation of appropriate corrective actions. For these reasons, the NRC has determined that this violation will not be cited as this violation meets the criteria specified in Section V.G.1 of Appendix C to 10 CFR Part 2.
However, the NRC will perform a routine review of the actions taken by the licensee to verify that corrective actions have been fully implemented. This review will be performed during followup of the corrective actions specified in LER 89-022, issued by the licensee to address this issue.
Although no violation is being cited, the NRC is concerned with OPPD's implementation of the checks and balances provided during review of 50.59 evaluations to ensure that unresolved safety questions do not exist in approved procedures. 'The.NRC expects that identification of unresolved safety questions will be made prior to approval of a procedure change and presentation of the procedure to the operations staff for performance.
It is especially.
noteworthy that an alert and conscientious shift supervisor identified the problem with the procedure and prevented performance of the testing directed by the procedure.
Overall, it-appeared that the licensee's perforniance in addressing the two apparent violations was proactive, timely, and conservative.
It appeared that
.l the licensee adequately identified the root causes for the violations and took L
short-and long-term actions to prevent recurrence.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, L
Title 10, Code of Federal Regulations, a copy of this letter and its enclosure will be placed in the NRC Public Document Room.
