Dear Senator D'Amato:

This islin response to your letter of September 20, 1983, to the Nuclear l

Regulatory Comission which enclosed a letter from your constituent, Mr. Albert E.-Krewer of Brooklyn, New York, in which he expressed concern regarding evacuation at.the Indian Point Nuclear Power Station during severe 1;eather conditions.

The Nuclear Regulatory Commission (NRC) has been an active participant in the Federal ~ government's coordination program to assure effective emergency

- planning in the. environs surrounding a nuclear power facility. However, the NRC is_ primarily responsible for assessing the adequacy of onsite emergency 4

plans developed by nuclear power plant licensees.

The Federal Emergency ManagementAgency(FEMA),by.Presidentia1' directive, hasbeenassignedthe responsibility for assessing the odequacy of offsite emergency planning around nuclear power plants. Accorci;ngly,1 e forwarding a copy of your

-correspondence to FEMA Headquerters ft.r their consideration and response, Sincerely,

.5 W ASHINGTON, D. C 20696 p#,

au n 8 38s The_-Honorable Alfonse D'Amato nited States Senate-Washington,.DC.20510 Dear-Senator D'Amatot

n The Commission has asked me to reply to your letter of June'4,.

1986 requesting the-Commission to ask the Federal Emergency Management Agency- (FEMA) to conduct a public meeting on FEMA's asses'sment'of'the February 13, 1986 emergency plenning exercise-for the Shoreham Nuclear Power Plant.

. FEMA has said that its regulations do not require such.a public-

meeting, and the-Commission does not believe that it should H

second-guess FEMA on what FEMA's own regulations mean.

However, the Commission has ordered a public hearing on the exercise-

-results in which the principal interested parties, i~ncluding the State of New York and Suffolk County, can participate.

The. State of New York,-Suffolk County, and the Town of Southampton -

-submitted a~ request similar.to yours to the Commission-on June'3, and the Commission addressed this-request in-a-Memorandum and

. Order of June 6,.1986.

A copy.is enclosed for your-information.

I hope that this letter-responds adequately to your concerns.

Respectfully, 5
