On August 11, 1981 the Atomic Safety and Licensing Appeal Board issued a decision which reversed a previous Licensing Board initial decision pro-hibiting the storage of spent reactor fuel from Oconee Nuclear Station at McGuire Nuclear Station. As a result of the Appeal Board decision, the NRC Staff was authorized to issue the requested license amendment subject to the imposition of a license condition detailed in the decision regarding admini-strative controls on spent fuel cask movement inside the fuel, building.

The NRC Staff has drafted a license amendment consisting of several license conditions and a change to the Technical Specifications. The proposed li-cense conditions are as follows:

The licensee is authorized to receive from the Oconee Nuclear Station, Units 1, 2 and 3, possess, and store irradiated Oconee fuel assemblies containing special nuclear material, enriched to not more than 3.24%

by weight U-235 subject to the following conditions:

a.

Oconec fuel assemblies may not be placed in the McGuire Nuclear Station, Unit 1 and 2, reactors, b.

Irradiated fuel shipped to McGuire from Oconee shall have been removed from the Oconee reactor no less than 270 days prior to shipment.

c.

No more than 300 Oconee irradiated fuel assemblies shall be re-0 07 ceived for storage at McGuire Unit 1.

Burnup of Oconee fuel shipped shall be no greater than 36,000

Receipt of irradiated Oconee fuel shall be limited by the use of

the NES-4 (NAC-1) or NLI-1/2: spent fuel casks.

The spent fuel pool crane travel shall be restricted-by ad-ministrative controls to the paths required by Technical Specification 3/4 9.7 whenever.a spent fuel cask is being handled.

Accordingly, it is requested that the NRC Staff expedite the issuance of this amendment for the reasons stated in Mr. A. C. Thies' letter to.

Pr. Darrel G. Eisenhut on September 10, 1981.
