We have received : copy of your Technical Specification Change Request No. 70 i
dated July 9,1981, which was filed with the Office of Nuclear Reactor Regulation j
(0NRR) for review.
This request proposed revised RPS setpoints for Crystal River Unit No. 3 and included a check in the amount of $4,000 (Class III) pursuant to 10 CFR 170.22.
4, Based on information provided to us by the OHRR staff, it has been determined that your July 9 request is considered to be part of your application for an ir. crease in power, and is covered under the Class V fee paid with previous submittals(October 31, 1978 and February 28,1979). On this basis, your 4
compas;y is entitled to a refund.
i In connection with another matter, our letter to you dated July 1,1981, requested a Class II fee of $1,200 per 10 CFR 170.22 for your May 21, 1980 application relating to clarification of the definition of "crerable". To date. this fee has not been paid. On July 10,1981, the ONRR staff completed the review for this application and issued Amendment No. 40 to 1.icensa No.
DPR-72..It is the ONRR scaff's final analysis that the previously determined Class II fee is still appr,priate.
l Since the $1,200 foe requested in our July.1 letter has not been paid, we zre subtracting that fee fmn the ^$4,000 refund dae you for your July 9 Change Request No. 70. Consequently, we ere concurrently authorizing the Office of the Controller to refund a sum of $2,800 to your company. We hope that you will find this trtnsaction to be an acceptable one. Refunds are generally.
processed by the Office of the Controller within approximately two weeks.
