COMMENTS ON STAFF BRIEFING In an open meeting held on Friday, August 28, 1981, the NRC Staff briefed Commissioner Gilinsky on uncontested issues in the Diablo Canyon low power proceeding.
The Commission would again like to provide parties with an opportunity to respond in writing to any discussion which touched upon issues relevant to contentions of Joint Intervenors or subjects of Governor Brown hich were rejected as matters in controversy by the Licensing Board and remain subject to appeal.
This is to notify the parties to this proceeding that such written comments should be submitted to the Secretary of the Commission by September 3, 1981, to ensure consideration by the mommission in its determination whether to permit the Licensing Board's initial decision to go into effect so as to authorize issuance of the fuel loading and low power testing license for Diablo Canyon Unit 1.
Favorable rcsolution of the physical security issues by the Appeal Board remains a prerequisite to license issuance.
