As a Nuclear Medicine physician, dealing with the administrations of radionuclides to patients, the re-opening of the General Electric reactor would insure a ready supply of radionuclides.

Of course, no one would want the reactor to be re-opened if there was a danger to the population in the area of the reactor, but once proper precautions have been made to the reactor and the building housing reactor, then there should be no further delay in the restartirg of this facility.

Dear Mr. Grossman:

It is my understanding the U.S. Nuclear Regulatory Commission (NRC) will be holding hearings near the end of May regarding the re-opening of the General Electric Test Reactor at Vallecitos in Alameda County, California.

Several years ago, the reactor was ordered shut dt.wn due to suspected earthquake fault hazard in close proximity to the reactor site.

It is further my understanding the recent safety evaluation report issued by the NRC represents agreement now between G.E., its geological consul-tants, independent geology experts, and NRC's advisory committee on reac-tor safeguards, that the reactor, with modifications, can safely withstand a strong earthquake on the suspected fault.

Based on that conclusion, I respectfully request your support and strongly urge the Commission to rule in favor of the re-opening of the General Electric Test Reactor.

It is a facility which has served the country and mankind as one of the world's largest producers of radioactive medical products.

With your favorable ruling, G.E. can re-establish itself as a leading producer of medical radioisotope and at very minimal risk to the populace.

Dear Mr. Grossman:

The Nuclear Medicine Service at the Long Beach VA Medical Center is in full support of the recu=ption of the General Electric Test Reactor for the production of radioisotopes. We have received diagnostic radio-isotopes for medical use from this facility in the past and eagerly look forward to having this source returned to our supply lines.

'Je use radioactive materials daily in the diagnosis and treatment of patients and the availability of these substances for the perfor=ance of safe and noninvasive tests are instrumental in the care of thousands of patients per year including the direct saving of patients' lives by early diagnosis of life-threatening illneases.

broaden the scope and numbers of suppliers. Obviously safety factors have to be of prime consideration, however, once these matters are resolved then every effort should be made to relicense those facilities that have shown their ability to conforn to safety regulations and provide high quality radioagents.

On October of 1977 *.he General Electric Reactor at Vallecitos was shut down by the Nuclear Regulatory Commission as a precaution due to a suspected earthqua'e faul t.

In January of 1981 three and one quarter years later, the NKC finally issued a report that the G.E. Reactor, with certain nodifications, could safely withstand a strong earth-g quake.

This report was very well received by many people in the Liver-I.

more Valley. Many of us have watched your procedure with great interest.

Not only was G.E. one of the world's largest producers of radioactive medical products, but it was an employer of many valley residents.

I was very pleased that the NRC was again going to allow G.E. to become a viable part of our conmunity.

Now I read by the media you have grantec yet another hearing which has no bearing on your closure of G.E.

In 1977 and has nothing to do with the earthquake question.

I am surprised that your Commission allows this type of maneuver to take place - to add more red tape to be placed in front of the G.E. Company.

This new hearing will only rehash the emotional pleas to stop any and all nuclear development - no matter how the technology progresses. We do not need the Berkeley-based Congress-man and the Friends of the darth to speak for or against our valley interests, if this were such an important problem to our' area, I'm sure our own Congressman would have requested the hearing.

No matter how many hearings are granted, or how much time and money are given to these procedures, no one will change his mind relating to use of nuclear power.

They use your organization, and others, to get media attention and at the same time spend tax dollars in order to gain support for their own purposes.

Therefore,I strongly disagree with this hearing and with the method by which public Commissions are imposed' upon to promote media coverage as a stage for politicians and organizations on a subject that has no bear-Ing on:the origina e of closing G.E. Vallecitos in 1977 M

Dear Mr. Grossman:

International Nutronics, Inc., (INI) has been a buyer of Cobalt 60 from General Electric. GE1x, since 1969 until the facility was closed, furnished all of our isotope requirements at a very competitive price with excellent service.

INI owns and operates three radiation facilities that do contract radiation sterilization of medical disposable products, and radiation testing of component parts for nuclear reactors.

As such we must have a reliable and competitive source for radiation material.

The effect of the close down of GETR has placed our company in a posi-tion of increased costs of cobalt under lead times ci greater length

than GETR. Our only reliable source today is A.E.C.L.

Since the closing of GETR, the Canadians have raised the price of cobalt from

For approximately four years the General Electric test reactor has been shut down, af ter a long tenure safe operation and substanial contributions to the research of nuclear power and energy.

While I cannot testify to geological considerations I do believe myself to be typic.al of local residents and business-people.

Our f amily has resided in Pleasanton almost 14 years.

We moved there fully aware of the test reactor's presence.

Never, including the mcst recent four years, have we been' concerned about danger from an accident or event at the reactor.

We are fully aware of the several earthquake f aul t traces that traverse the Anador Valley, Neither do the latter concern us.

You are certainly aware of the many f acilities both public and private which have been constructed near these traces.

No damage or evidence there of has occured to schools, freeways, hospitals or other structures.

As a business person I have significant investments in the Plessanton area, and plan more, - again fully aware but completely unafraid of the reactor's presence.

It would seem to me to ba good location for such c test f acility, reasonably near transportation and other test facilities.

More important however is the proximity of qualified research and technical personnel, who have demonstrated a desire to work at Vallecitos and more importantly live in Pleasanton, Dublin, and Livermore.

Mr. Grossman you may be assured of. side soread public support forthe test reactor's presence in the valley and an even stronger concern for public agencies who appear to be intimidated by minority special interest groups.

Show Cause Proceeding My work involves nuclear medicine and the use of radioactive isotopes.

I would Itke to speak in favor of reactivating the GETR, since it is only one of two radioisotope producers and one of only three in all of North and South America, i ts reactivation would provide more competition in keeping cost of isotopes down.

In addition, a lot of sales have been lost to foreign competitors.

The continued competitive flow of radioisotopes for use in nuclear medicine is essential.

The intent of this letter is to make a limited appearsneein writing and to provide written testimony relative to the show cause proceeding as referenced above.

As background materiai, I am the President and General Manager of J.L.

Shepherd & Associate.'.

J. L. Shepherd & Associates is the major manufacturer in the United States of research equipment and calibration equipnient which incor-porates Cobalt-60 sources. We are, in fact, the sole competition m the United States of the major foreign corporation which also services this market. For the past 15 years, we have depended upon General Electric Vallecitos Lab ano the General Electric Test Reactor to provide us with the Cobalt-60 which is incor-porated in our equipment. This Cobalt-60 supplied by GE has been used in devices of our manufacture for major successful programs in combating leukemia, for radiation hardness testing of all interplanetary vehicles developed for NASA by Jet Propulsion Laboratories, for radi tion hardness testing of military hardware and for general radiobiological and chemical research at many labs throughout the country.

Since the temporary closure of GETR and the inability of General Electric to meet our requirements for Cobalt-60 sources, we have been unable to effectively compete vith the foreign organization which is our only competitor in this area because of the necessity of purchasing Cobalt-60 from this organization. Over an extended period of time, we have found General Electric to be a most co-operative and competitive organization in meeting our specific requirements for Cobalt-60 The return of GETR to operation will result in major benefits for the research and development organizations in the United States who require the use of Cobalt-60 in devices such as we manufacture to continue their research

programs and will eliminate the very unhappy situation where a single foreign NN J

competitor has sole control of this inarket.

Dear Mr. Grossman:

A long time has gone by since the General Electric Test Reactor at Vallecitos was shut down.

I'm certain that large sums of money have been spent on all. sides of the issue to determine whether or not the site and the reactor are safe from a seismic standpoint. Hopefully. that has been deter-iained in the affirmative.

I would like to express my feelings as a citizen, businessman and elected official who lives in the valley where the reactor,is located, about the current nuclear remonstrance.

Let me begin by saying that the General Electric Vallecitos Plant has been a great asset to our area in terms of its contribution of quality personnel who have Decome involved and respected citizens of our towns.

It has contributed to our economit. well being by providing employment, payrolls and taxes to the area.

I have never heard any comments about the plant, its operation or its employees that was in anyway negative. The entire operation enjoys a most respected reputation.

I have been following with interest tne anti-nuclear actions of some of our more liberal congressmen and their affiliated organizaticns. I have concluded that the entire question of nuclear energy and its det.iments or benefits to man will never be resolved to everyones satisfaction.

People who are intent on seeing only the negative aspects of nuclear power would have us continue to burn coal, gas and oil,and further pollute our atmosphere. They would turn their backs on the many wonderful contributions nuclear energy has made and can continue to make to medicine, travel, engineering and space sciences. Only by lifting our consciousness above the level of rejective commentary can we progress forward in this most vital area of nuclear technology. It is unfortunate that our peoples first experience with this tremendous resource was a bomb. We seen to hold on to that intage with an almost calamitous obsession.

us who live here in the valley should have particular interest in that regard.

I, and I believe I speak for many others, have concluded that we are not in any -

grave danger from progress. Appropriate safeguards are essential in every under-taking and particularly in the nuclear industry. With these safeguards in place j

we must go forward and enrich our lives by using the intelligence that God has j

given us to discover and enjoy the world in which we live.

l I urge you to allow General Electric to restore its operation and provide important radioisotopes t.o the medical community.

I urge you further to take an aggressive stance for the well controlled expansion of nuclear energy for the benefit of all of us.

Although it is lengthy, its content establishes reference to the negative impact probacility and in fact on our business.

Now, some thirty six months later, we strongly petition you to accelerate a favorable decision for GETR to restart the reactor at the most immediate practicable date. May we relate the injury that the Radx Corp, has sus-tained because of the shut down of the GETR unit.

As a "small business concern" we have had to accept much higher xenon gas costs as a result of the higher raw material cost incurred by General Electric having to buy from a competing reactor operator. This operator has become larger as a consequence and has taken accounts away from Radx and GETR as a direct result of their price advantage.

We have been obliged to ship on a restricted availability schedule (e.g.

Mondays and Fridays) which creates hardhip for our accounts and plays into the hands of our competitors who can ship any day in the week. In brief, we could not compete with this competitor who is the present supplier to GETR.

Our price to the customer ranges from.39 cents to

.24 cents per millicurie; thus, this availability problem for Radx resulting from the GETR shut down has cost us significant business and has graphically increased the cost of medical examinations throughout the country.

We have been compelled to accepc and to forecast a continuing decline in our xenon gas business - absolutely due to the GETR shut down - and for a small business" the proven advantage this gives to the principal competitor referenced is to foretell our demise as a participant in the xenon gas business.

The competitor has grown, and has recently been purchased by a foreign corporation, and has increased promotional pressures; thus, has taken l

accounts from us that we confidently predict would not have been lost had the GETR reactor been supplying our needs on a competitive lower cost and when needed basis.

The evidence accumulated by us during the past 36 months indicates that you can be a mejor factor in our success (or failure) as major participant in the l

health care aspccts of Xenon-133 diagnostic services. We urge your full l

consideration of our petition, plus the reams of data GE has provided to support a favorable decision to allow a restart of GETR.

As a user of radioisotopes in a health care facility located in the rural western United States the impending restart of the General Electric Test Reactor located in California is of prime importance to me.

Delivery of radioisotope on a demand basis is presently a two-day wait at thic institution.

Due to this lag time of delivery of radioisotopes patient quality care suffers.

If General Electric is granted permission to restart their test reactor in California this will allow for delivery of radioisotopes to this institution in one !ay or less.

This single fact would allow the Nuclear Medicine Department at this institution to respond much more quickly to the physicians' and patients' needs as required. This will also allow us to decrease our stock on hand and therefore decrease our inventory cost.

In this day and age of consideration and concern for health care costs this fact seems worth mentioning.

In conclusion I strongly support the reopening and restart of the General Electric Test Reactor in California.

u-clear Regulatory Commission to permit General Electric to return its test reactor (GETR) to full operation.

It has now been approx-imately three and one-half years since that reactor was shut down

,because of concern that an earthc,aake might permit radioactivity to be released into the environment.

I understand that appropriate studies have been carried out by General Electric which have satisfied the NRC and its advisory commi, tee on reactor safeguards.

The matter is now set for a pub-lic hearing on May 27, 1981.

The shut down of the GETR has been very costly, not only to General Electric which was required to carry out the appropriate ctudies, but also costly to the medical care of patients who re-ceit ad radioactive materials for a variety of diagnostic and thera-pentic procedures.

As one involved full time in the practice of nuclear medicine, 1 am indeed hopeful that the public hearings will permit the GETR t6 become fully functionally in the very near future.

If so, I fully expect its operation to have a f avorable impact not only in a lower cost for many radionuclides, but also having them more readily available when needed for the practice of nuclear medicine.

Every natirn in the world, many with people starving to death in the streets, is spending incomprehensible amounts of money on nuclear power.

In the meantime, the United States allows a handful of uninformed, uneducated bleeding hearts to bring our " peaceful use" programs to a halt.

Not our weapons program, but the programs that help save lives and energy!!

should have never been shut down to begin with, and anyone with the most remote expertise knows that.

Some exploratory investigation to the charges perhaps, but not shut down!

All that has been accomplished is the loss of millions of dollars of tax base.

My qualifications include being a full member of the Health Physics Society, 24 years involved in surface device testing, nuclear powered vessels,

"Ierva" program, handling and manufacture of hi-level sources, and waste handling.

I have been associated w.2.th certain operational areas of G.E.T.R.

from my first visit to the facility in 1965 tc present.

The G.E.T.R.

facility is a model showcase for the proper, safe and professional handling of radio-active materials.

Our industry has problems, but they damn sure aren't and never have been at G.E.T.R.

It is ludicrous that this facility was shut down to begin with and every day it remains closed is an embarrassment to those associated with causing

l In as much as we are dependent upon radiopharmaceuticals, it would be enormously beneficial if the General Electric Test Reactor were allowed l

to gear up for production.

It is my understanding that this facility provides a signif-icant benefit to society by reason of production of medical grade radioisotopes.

I am advised that early this year it had been determined that the plant can be safely operated, and after modifications have been made, can safely withstand a strong earthquake on a i

suspected fault.

I am persuaded that if the above findings can be made, the benefit to society far outweighs the risks incurred and, therefore, strongly support its return to operation.

Dear Sir:

The test reactor at Vallecitos was ordered to shut down in October, 1977 by NRC pending investigation of a suspected earthquake fault in the area.

After many months of disagreement, it was concluded (NRC Safety Report) in 1981 that the reactor can be made safe to withstand strong seismic activity.

Since then certain interests have asked for public hearings continuing f rom May 27, 1981.

I would like to go on record as favoring re-opening the fac'ility and believe that ance the safety or the structures is reasonably demonstrated, the reactor will be a valuable medical and experimental asset to the na tion.

On May 27 of this year, the Atomic Safety and Licensing Board will commence hearings on the re-opening of the General Electric Test Reactor at Vallecitos.

It is my understanding the matter l

will be considered on Docket 50-70, General Electric Test Reactor.

Yv turnose in writing you is to support the efforts to re-open this vital facility for the continuance of -its research to find the sources of power for the future.

Throughout the previous decade, I served as a public official in the area of Vallecitos.

From 1972 through 1976 I served-l on the Pleacanton City Council as both a member and as mayor.

From 1976 until 1980 I served as a Director of Alameda County Flood Control and Water Conservation District Zone 7.

During those years, many of the decisions made by those bodies were related to the preservation of the quality of our environment l

and safety of our citizens.

The countless documents which I l

reviewed to make those decisions failed to convince me that l

there were sufficient reasons to keep Vallecitos closed once l

the geological studies were completed.

Please loo'c favorably upon the request to allow the very important work at Vallecitos to resume.

I am totally familiar with the geographical area where the General Electric Test Reactor at Vallecitos is loca ted.

I believe I am well informed as to the current situation concerning suspected earthquake faults near the GE Tes t Reactor at Vallecitos, Sunol, Cal.ifornia.

In January 1981 the NRC issued its Safety Evaluation Report on the l

above facility. That report represents agreement with GE, its geolociagal consultants, independent geology experts, and the NRC's Advisory Committee on Reactor Safeguards, that the Test Reactor with certain modifications i

l can safely withstand a strong earthquake on the suspected fault.

l Further hearings concerning the Vallecitos are serving only political grandstanding purposes of several California politicians seeking l

approval from radical, stop progress, political faction groups.

In light of the new spirit brought forth with the election of President Reagan, aad his resolve to get this country going again afte,r two decades of a congress run by dcmocrates, the continuation of further hearings at the requests of Demo. Congressman Ron Dellums, demonstrates mostly that your committee is more interested in playing politics than dealing with the needs of the country.

"Getting government off the backs of people" as our President is determined to do, includes amoung other things, breaking up red-taped, block progress, political games playing l

hearings as you are continuing to conduct on the Vallecitos faciting.

Now that the s1fety issue has been resolved, you breach the trust of agreement with Gener.d Electric, by forcing them back through more and more hearings.

The best interests of the welfare of our citizens was re ched in good faith when initial safaguards were agreed to in January of 1981.

It is my hope that your commission will be substantially restructured by President Reagan to prevent your committee fron continuing to act N maverick running roughshod over ever rule of fair play.
